Q:Stalled construction of CASE Univis Cielo C building. If it is due to TMC not providing the permit, what is it that the builder has violated that has compelled the TMC take such action? Is there a way to find out what is the real reason with TMC directly and also whether there is any legal way out builder can take corrective action to resolve the problem? Q:For Casa Univis (or is it now Splendora?) Egnis E, I once again got a call urging me to take Fitout possession. They are not offering any information on OC and consequently the final possession except to say that they have applied for it. But they are trying to get more money out of me by offering fitout possession. Also, on CAM they are saying that it will start from Jan 15, 2013. When I don't have possession of the flat how can they expect me to pay for maintaining it? Also, they have not addressed the issue of doubling the maintenance charges from what was agreed upon. Also, when I asked them if the clubhouse, pool and other infrastructure is ready, they haven't answered in the affirmative. These, by the way, are what this maintenance charge is supposed to be going towards. So, basically Lodha expects the buyer to pay for maintaining infrastructure that isn't ready yet and that the buyer doesn't legally have a right to use.
Latest Answer: Virkram, Rajesh is right - all the hill top clubhouse, cluster club house was marketing gimmick - they are the marketing genius - you have to give it to them. As far as the plans, brochures - there is one beautiful "*" that says terms and conditions apply. These terms and conditions state they can change the other plans without notice .. bla .. bla.. so technically, its difficult to prove them on wrong in a legal suit. In certain cases you clearly can - like delay , but one has to be prepared to take on the fight and put sustained efforts.

Q:Hi i have booked 3bhk flat in casa rio, i have pain 80% of payment and due to some unavoidable circumstance there will be some delay from my side in paying balance 20% of cost, i am ready to pay delay payment penalty 18% also, i just want to know what is the maximum time frame lodha can grant to me before they initiate cancellation procedure.
I contacted Lodha today and was informed by Vivek Koshti that the possession date for Ceilo C is going to be further postponed to May 2014. They will be sending the letters/email to all the customer next week. This is due to not getting approvals from TMC.
They also informed that they are not planning to pay any compensation/interest payment for the delayed possession as the reason for delay is beyond builders control.
I booked the flat in 2009 and have been paying the interest on loan to bank for last 2 years. I am not comfortable to continue paying further cost for Lodha not managing the project efficiently. I am planning to seek legal options for what can be done in this scenario apart from going to consumer court. I will appreciate if you guys can let me know if you have received any communications from Lodha on this and if you are planning to take any legal action.

Latest Answer: Count me in....my investment was in Cielo D. I have sent a number of contract binding letters to them. Due to this pressure they did offer me an alternate proposal. But I soon realised that they were trying to pry some more money in this pretext asking me pay more for a lesser carpet area and for the Platino option. Q:How many people have taken fitout possession? Is there any information about it?
The builder is saying that OC will come in about 6-8 months. What is the point to taking fitout possession other than paying the builder the full amount?
Why is the builder charging CAM from 31st, October? My understanding is that as long as the builder doesn't given possession (full possession where I can live in the building) they have possession of the property and therefore any maintenance is their responsibility. How can this be transferred to the buyer without giving possession?
Q:Guys as you all must be knowing that our project has been delayed by more than 2 years. In my each meeting and written communication with LODHA 'bout the compensation for the delay possession, I was getting replay that that will be adjusted during the possession demand letter. But now last week when I asked my customer representative for a site visit, she asked me to pay the remaining 5% of the consideration i.e. nothing but the possession amount else I won't be allowed for a site visit. And she also confirmed LODHA is in no mood to pay the compensation to us for the delay payment. I asked her that by saying this they are breaching the contract mentioned in the Sale agreement. They said they don't bother 'bout this. So guys I've decided not to pay the possession amount and go to the consumer court. I also think you all will get the same response when you'll be aksing for the compensation. Guys please share your experience and opinion.

Q:I have booked a flat in Ignis 'F'. According to the agreement the builder is liable to pay interest on delayed possession after Dec 2011. When I spoke to the customer service person, he told me there is a clause (24) in the agreement which says if any payment is delayed from the buyers side, the builders interest on delayed possession will get forfeited. I have already paid interest on one delayed payment. Can the builder still not pay penalty on delayed possession?
Latest Answer: Gurav, As far as I know the builder's claim is false. There's no such thing. I'm also trying for the compensation from the builder for my flat in IGNIS-E. Earlier they said it'll be adjusted with the possession demand letter but now they are sayiing it won't be possible for them to pay the compensation as the delay was beyond their control. I've planned to go legal way through consumer court. To get the compensation from the builder in case of delay in possession, the only clause that needs to be there in the agreement is that the builder is liable to pay some percentage to buyer on demand. If it's there then we can fight in consumer court and he'll give us. We can also talk regarding this.
Q:My name is Varsha, I have bought a flat in Tiera "A" wing in Sept 2009 and registered in the same month. Till today the construction has reached only the 11th floor and is awaiting permissions. Plz shed some light on the real causes of such a big delay. Also I have received a letter from Lodha about 5% VAT and it is to be paid within 15 days of the receipt of the letter or else it will attract some additional interest. Although we registered in Sept 2009 but had made very little payments until march 2010 (after which the VAT was slashed to 1%). Do we still have to pay the 5% VAT or should it be charged as and how the construction progresses? (like the service tax)
Latest Answer: Hey Raj, Brilliant point so well explained by you. This surely makes the point clear for most of us. Let me also take the opportunity to share a thought that, LODHA is just playing on the psyche of the purchaser by sending him demand with interest on delayed payment, legal notices for cancellation (thast a joke coz they are illegal). So please do not fall prey to these tricks, just tell them u will not pay, period. Also note they can charge interest only from the time of layout plan approval and Construction Clearance Permission date (for your floor), whichever is later. So most of their calculations and demand letters can be conviniently ignored.
Hope this helps. So stop paying completely, till they have permissions for the entire building documented and sent to you.
