Q: For Casa Univis (or is it now Splendora?) Egnis E, I once again got a call urging me to take Fitout possession. They are not offering any information on OC and consequently the final possession except to say that they have applied for it. But they are trying to get more money out of me by offering fitout possession. Also, on CAM they are saying that it will start from Jan 15, 2013. When I don't have possession of the flat how can they expect me to pay for maintaining it? Also, they have not addressed the issue of doubling the maintenance charges from what was agreed upon.
Also, when I asked them if the clubhouse, pool and other infrastructure is ready, they haven't answered in the affirmative. These, by the way, are what this maintenance charge is supposed to be going towards. So, basically Lodha expects the buyer to pay for maintaining infrastructure that isn't ready yet and that the buyer doesn't legally have a right to use.
Virkram, Rajesh is right - all the hill top clubhouse, cluster club house was marketing gimmick - they are the marketing genius - you have to give it to them. As far as the plans, brochures - there is one beautiful "*" that says terms and conditions apply. These terms and conditions state they can change the other plans without notice .. bla .. bla.. so technically, its difficult to prove them on wrong in a legal suit. In certain cases you clearly can - like delay , but one has to be prepared to take on the fight and put sustained efforts.
Vikram, after waiting for more than 4-years ,people desperate for accommodation have moved in .I am told that most of the buildings in Mumbai get occupied while the OC even takes a year OR more after they have occupied the flats. With regards to the so called cluster swimming pool (which was just a marketing stunt to lure buyers) infact does not look more than a pit filled with water. They cancelled the Hill top club house as well & are building Towers in that place. Time will tell ,what they deliver. What a pity!!!
Rajesh, Thanks for the update. Surprising to hear that some flats are already occupied. Is this the norm? Sad to hear about the size of the swimming pool. I've seen other Lodha properties and generally their club house and pool are of a good size. Let's assume the main club house will be bigger and better.
Yesterday, I visited the site. The flats in D, E & F are complete & as per Lodha's 60 flats have taken up possession, while 6/7 flats are occupied. Temporary Power suppy has been given & drinking water is being delivered home on requests. The car park is almost ready. Lifts are fully operational. The cluster Club house is ready to be used with one carom board put up there. The Gym has a few cardio equipments. The surprising element was the cluster swimming pool'(approximately 20' X'10'), which is so small that forget an adult, even a child cannot swim & they call it a swimming pool. What a shame!!! God alone knows what further surprises are stored in for us.
Yes, I feel this is total injustice. How can they just double maintenance charges without even giving any facilities and amenities. Also, Common Area Maintenance (CAM) Fees should be paid only after giving possession. This is not done. We should all oppose about the same.
We all are in the same situation. Ideally, as far as possible, we should ignore their call for Fit-out possession & keep following up for possession with Occupation Certificate. On the demand for higher CAM & the CAM charges to start prior to possession should be opposed by one & all.CAM charges should only start on physical possession. We are only obliged to pay the builder as per the registered agreement. Any cost increase to be opposed.
