Difference between building completion certificate and occupancy certificate.
Q: I ask the builder to provide me with the occupancy certificate but he gave me a building completion certificate. Are both the same or is there any difference?
Legally, After submit an application with the commissioner for the OC within 30 days of completion of the building/property. The commissioner also replies to the applicant within 30 days whether the application has been accepted or rejected. It is wise and significant for the buyer to get the OC before moving into the flat or signing the agreement.
In most of the case, builder will provide all formalities regarding OC from authorities but anyway the following step is required to obtain OC:
1. Builder needs to fill an occupancy certificate application form along with a necessary documents.
2. After submitting the form, authorities will inspect the complex.
3. Give confirmation whether it has been completed according to the approved plan
4. Then issue the certificate.
Hi Micheal, as per my experience while buying property following document is required to obtain OC: 1. Copy of sanction Plan 2. Completion certificate 3. Commencement certificate 4. Tax receipt 5. NOC from various department like pollution, fire etc.
@ Micheal Once the project is completed, it is necessary for the builder to receive an Occupancy Certificate also known as Completion Certificate. This certifies that the building has complied with the approved plans.
As per laws, a flat owner can occupy an apartment only once the OC is issued also it is mandatory for every residential complex to obtain the Occupancy Certificate which has more than five units.
OC is not required for registration of the property during purchase so that most of the buyer ignore this document, but it is one of the most important paper when you are going to apply for Khata. Without OC, buyer will have to face problems in obtaining Khata.
Hi , I bought a flat with reputed builder, but the property is not registered under reara ,It was in prelaunch and he took the 20% without the contract was ready , then they asked for 85% within 6 months and then for 15% work they took 2 years , the possesion was in August 2017 but even after saying project is goign very fast to collect the 85% money they moved to grace period and by then GST came in picture , they applied for OC on APRIL 2017, as per my understanding the OC is only applied when property is complete an hence GST should not be applicable , but these guys are saying that GST is applicable on full 15% . Is it legal and where I can approach to complain the same? Is going to consumer forum will help? they are asking 230000 extra ,
Who issues the Occupancy Certificate, builder or Municipal Authorities? If it is municipal authorities will they issue for individual flats in an apartment complex or a single certificate for the complex?
If it is for individual apartment then is the onus lies on the apartment owner to get it?
If the builder issues it, then he can issues at his own will isn't it. I mean he can issue it even if the apartment is not ready for occupation.
occupancy certificate is issued by local municipal authorites or building proposal department that provides no objection to occupy the building under reference for its specified use. The OC is issued only once the building has been completed in all respects and can be occupied.
Completion certificate shows that the building construction is done as per the plan which was approved by the concerned authorities. And after getting this, occupancy certificate will be given to all buyers so that they can take possession of their homes.
Occupancy certificate is an important document. This certificate is given to the owner after the completion of the building and you can occupy. You will not get water connection and sanitary connection without the occupancy certificate. Building completion certificate is given by the municipal authority after completion of all the formalities by the builders.
