Any issue with I Tower of Cloud9, Indrapuram?

Q: I visited the site in March'12 and then in June'12. I can hardly see any progress in the I tower. Can anyone tell me if there is any legal issue with I-Tower of Cloud9 Indrapuram? I would also like to know if there is any online group of people who have invested in I-tower so that I can stay connected to this group for questions and updates.

The builder never had permissions to build the " I " Tower and he went on to book the flats from people thinking that he will get it done by money power. I have information that they never had any permission to build the tower and they still don't have. I think by the time elections are over , we should form a group and if the work doesn't start, we can push charges against the builder for doing a fraud with buyers. We all know what happened to Supertech recently ( court asked to return @14%) even though they had approvals. In our case there was no approval AT ALL.

I have not yet received reply of My legal notice to the builder. i have to give him 30 days ka time to reply and its 15 days he has not yet replied. I have sold my property after talking to lawyer and also got a hefty compensation. After payment of bank loan and considering the interest rate, I get to pocket Rs 21 lakh. This was possible because my lawyer threatened to take Rishabh to court since they don't have permit and they illegally collected money. I had filed an RTI application and I managed to uncover the racket.

My point of view is that they are planning some big game...they want people to withdraw and the moment they get approvals they will sell flats at elevated current rates. if majority is of a view to wait than i have no problems with that when we have waited for 2.5 yeras than 2 months is no big deal. But atleast a group meeting is must with the builder to mount pressure on him.

Dear All i think a Meeting of all flat owners followed by a Consumer application or Fraud case on Builder is only solution. But for that atleast one meeting is required so that we can put collective presure on builder. he will keep fooling individuals but if everybody will go together than burden will lie on him. I think we should wait till Oct-Nov and after that we all jointly should initially lodge FIR against the builder with Police Crime Branch- EOW (Economic Offence Wing) and also a complaint to CREDAI west UP. We can also personally meet with DM, Ghaziabad to submit him a written complaint. This action will affirm our side in any legal proceedings.

Dear Nitin, it's a trap. Don't fall for it. These people have got their approvals after a lot of delay and construction is going to begin soon. Now they want to return our money so that they can sell the houses again at revised market rates and make money out of it. I bought a 2BHK flat at Rs 30.75 lakh. Now, the same flat costs over Rs 50 lakh. The builder wants to cheat us.

has anyone received possesion date in writing for B-C-D-E towers ? I had booked in C tower in Oct 10 and that time they promissed to complete by Dec 12. Howeve it got delayed and in Dec 12 they assured to complete by Dec 13 (even before deewali). Still I do not see any sign of completion it's already July 13.

Unfortunaltely I didn't get any date/month/year in writing from them ever ... I wonder how to get this qualified to claim panalty clause.

Can anyone advise with their exp here?

Has anybody recently visited or talked with Rishabh people? i think we should talk to all workers at Rishabh like Rajnish, Ritika, Nishant etc separately so that we can get some clue of whats happening. Only talking to one Mr Jain (who is shrewd fellow) we will get stereotyped answer. Also what is the opinion of surrounding brokers, will also give us an idea. This will be at least some information than nothing, i mean should we wait or quit off the project?

How can GDA officer not approving? I think something wrong with either property paper or builder..

They wanted me to sign a letter that either I'll wait for 10-12 months without any objection or get a refund with 6% interest when they are constantly trying to get the approval from GDA (Ghaziabad Development Authority). They tried to allure me to consider my request to shift in other Towers in case some cancellation comes to get me signed the above mentioned letter. They wanted to sign and hand over the letter to them which I did not sign. But 2 things that I come to know I tower is approved for loans from customer care of HDFC and Corporation bank. But as per builder Land is owned by builder but GDA officer on current position is not approving and they will try for and wait for the transfer of that officer in these 10 -12 months. Now main thing how we should proceed. We should at least meet each other and decide for any future agenda.

Is there anybody who knows the Customer care email ID for Clould 9 project Indirapuram? From Quikr.com, I came to know that the scam of Rs. 500 crore has been made in this project. I don't know the reality of this. Has any body any idea on this?
I wrote them email at corporate@rishabhbuildcon.com to confirm. They are not responding to that. I also wrote at rajni.rishabh@gmail.com from where an invitation for Bhoomi Poojan came to my email id. Still no response. But if we go in consumer court and to proper authorities like the people who suffered in Noida Extension did, we can get the claims as a case of forgery can be filed against the Builder who is selling unapproved land to innocent Customers by telling them the project is approved and not telling the truth that out of that project, I tower is still not approved. At the time of sale, they did not mention that for some tower, only limited floors are approved say upto 12th floor is approved and rest are not.

I think we should get there together and claim for 6% interest (which is still less than if FD(of 9 to 9.5% interest) has been made) plus the appreciated value of land. If somebody has booked in Rs. 2690 / sq feet. Now it is Rs. 4500 per sq feet to Rs. 5000 per sq feet. So, almost 50% hike in land price from the time we booked. And if we have to buy from any where with in Indirapuram with the amount they will refund us, we will not be able to purchase any house in that amount. Penantly clause is there subject to approval.

Please go there and you will get surprise..they need us to sign a bond which mansion that they will not going to pay any claim as per penalty clause for next 10-12 months because they didn't receive approval yet. As per current information they will start construction probably in next year if all approval received.

even they are asking to exit with 6% interest.

Uptil 28th Oct,2012, there was no approval for I tower. I don't know the status as of today. They told me that they will meet the new Government in Dec, and till that time the construction was stopped at the site for Tower I only. Except the tower I, contruction till f,g,H tower was already complted till 6th floor. And a,b,c,d and E had completed till 25 th floor.

Hi ,

I too have booked in Jun 2011. Then I attended Bhoomi Poojn in Oct 2011 and paid 30% amount after booking (in I tower in Cloud 9) till date . On 28 Oct, 2012, when I visited the site and met Mr. Ajay Jain(Head of Sales and Marketing in Rishabh Cloud 9 project), he told me that the land is not approved till date. He told me that the approval process stuck because of change in Government in UP. He hopes that in Dec 12, the approval process will be completed.
