Q: 1. In the sale agreement the management write that the club house will be commercially exploited and can be given for use by public for meetings, conferences etc., That means they can literally rent it out. Are you happy with that statement. Have you fully read the sale agreement clause under the club house.The Karle Zenith sale agreement also write that they are not responsible for the quality of the services provided at the club house, if they appoint an agent or an external service provider. Is it okay like this?
This is a point no one cares to investigate. Is the club house part of super built up area charged to buyers. If yes then it cannot be rented out to third parties. If not charged and the builder is only providing life time membership then it can be rented out and exploited. So in that case then the UDS per flat will be very less and the club house will be owned by the builder
I work in AnZ, Manyata. I was looking to buy a 3bhk flat in Karle Zenith. However after some rumour of encroachment on a Storm Water Drain (SWD), I found out that they have completely blocked a Raja Kaluve (Storm Water Drain). Shame to do such a big project and not make provisions for a MAJOR Rajakaluve.
The statement "the club house will be commercially exploited " is not a legal term and club house renting out is not an exploitation unless it cause a nuisance for residents or the facility is restricted to owners. You should take the copy of sale agreement to your legal expert and clarify the doubts before you sign dotted lines. Thank you.
