Delayed Possession for CASA UNIVIS CEILO

Q: Hi All,

I contacted Lodha today and was informed by Vivek Koshti that the possession date for Ceilo C is going to be further postponed to May 2014. They will be sending the letters/email to all the customer next week. This is due to not getting approvals from TMC.

They also informed that they are not planning to pay any compensation/interest payment for the delayed possession as the reason for delay is beyond builders control.

I booked the flat in 2009 and have been paying the interest on loan to bank for last 2 years. I am not comfortable to continue paying further cost for Lodha not managing the project efficiently. I am planning to seek legal options for what can be done in this scenario apart from going to consumer court. I will appreciate if you guys can let me know if you have received any communications from Lodha on this and if you are planning to take any legal action.

Count me in....my investment was in Cielo D. I have sent a number of contract binding letters to them. Due to this pressure they did offer me an alternate proposal. But I soon realised that they were trying to pry some more money in this pretext asking me pay more for a lesser carpet area and for the Platino option. I second Shirish Keskar's option am perfectly on the same page as Kapoorbharat@gmail.com ...count me in guys..we cannot let them take us for a ride!!! My email ID: sdmenon@mailcity.com

Both the options do not make any sense -

Option a. Cancellation of booking and refund @ 12% - Lodha is selling the new properties in the same project @ 8100+ psf and expecting the buyers who have invested @ apporx 4000 psf to take the refund @ 12% so that Lodha can resell those flats along with other inventory at a much higher rate.

Option b. Continuing you booking – Lodha wants us to wait for another 2-3 years without a concrete finish date (i.e. 22 months after the approval, which he might not get for another 6+ months) and also forgo our right to any interest for delay in possession.

These options just show that builder thinks all us are at their mercy. I don't think we are under any obligation to accept these options. I agree we should get together and start an initiative against the builder. My e-mail ID is Kapoorbharat@gmail.com

We need to form a group and hire a good lawyer to file case of cheating against Lodha Builder. When we have spent lakhs in booking flat, let us spend few thousands each to hire good lawyer

BELOW MESSAGE I RECEIVED FROM LODHA OFFICE. DOES ANYONE ELSE RECEIVED SUCH LETTER?

a) Cancellation of your booking at Lodha Splendora - We will refund all monies paid to us towards consideration value along with 12%.

b) Continuing your booking – You may continue with your booking in Lodha Splendora with a revised fit-out possession date which would be of approximately 22 months from the date of receipt of approvals of your building and no interest of any nature whatsoever shall be payable on the amounts paid by you for delay in possession.

Alternatively I also heard that there was about 2,00,000 worth FSI approved from TMC earlier. This in all probability was utilized for the NEW Splendora since clients have paid more $$ and construction of floors would rake in more moolah for the builder so he got those FSI utilized for them and billed their new clients. Who cares for Ceilo tower if deadline has passed or not since the floor price given by Ceilo C users is less compared to new clients of Splendora. Hence no more FSI is left now. Also on a second thought from your note above- they would like the owners of Ceilo vacate their ownership and take back the capital with some little interest and then sell their vacate flats at much higher rates to new clients. Absolute unethical way of operating - the worst being no one from senior management wants to meet or make any assurance written statement to their clients

I do need to go out of country for some work assignments. These builders had a big realty expo in Kuwait and Lodha had showcased their Splendora project for obvious reasons. I gave the history to one of my colleagues who asked the sales guy present on the Ceilo delay. My colleague was informed that there were some Soil Issues due to which the Ceilo cluster is not receiving necessary approvals. Now with Mr. Das note above on what Ritesh Ghai has said, seems to be that this project does not seem to see the light at the end of the tunnel in near or distant future

The soil issue was concerend with Cielo D. The place where D is coming up is having hard magmatic rock, which took couple of years to excavate. Hence the D block is stuck up to the plinth level. However the FSI issue of Cielo C is not understood, since the construction is made on TMC approved plan and raised to the level of 12 th floor. However, one thing many of us might not have noticed is the TMC approved plan itself. The approved plan shows 2 nos. of 1.5 BHK in place of each 3 BHK Ultima. While I got the drawing last year I went at the site to enquire and the concerned site incharge could not explain the discrepancy.He showed to me that the flat is contructed according to the Brochure drawings and I should not be concerend with the TMC plan. In all probability, the present impasse is for the discrepancy in cosntruction with the TMC approved plan. I do not see any comment being made the Cielo D apartment owners. I do not know , whether there are any

I understand from Mr.Ritesh Ghai, AGM- Customer Care- Lodha , that Lodha is not getting CC for cosntruction beyond 12th floor, as there is a problem with obtaining FSI clearance from TMC. Hence both C & D buildings are stuck up till such CC is obtained. Understand from Mr.Ghai, that it may take even 6-7 months further time for obtaining CC. In that case all these promise of getting possession in May 14 is also a pie in sky. Moreover, Mr.Ghai informed that the maintenace cost is to be hiked by 50%, given the cost push. He also told that Lodha is contemplating to give an option to the buyers to opt out and compensate the buyers to the extent of bank FD rate. This sends shivers down my spine, as it will be impossible to buy another flat at the same budget and all the opportunities that are lost.I wonder when exactly the project will see the light of the day. We may have to initiate a PIL.

Thanks Mr. Das. Have you receievd anything in wirting from Lodha ? You are right,we need to initiate a PIL if this is the case. They cannot just give us an option to refund the money and compensate as per the bank FD rate. As a minimum, they need to pay us the prevailing rate in the market (which I think is around 8100 p/sq ft). Do you know why TMC is not giving CC for Ceilo C & D ?

Hey guys.. Without getting approvals they sell off the property assuring all approvals are in place.. later their originality is revealed.. helpless Buyers are forced to suffer..

Buyers should raise their voice against such builders and take appropriate action or else these builders will torture more and more buyers..

Hello.. I think it would be good if you take legal help or approach consumer court an put an end to their fake promises.. it is high time now. They have no concern for buyers at all..

There are few more discussions in this forum regarding the same issue.. I don't understand such a big realtor Lodha is doing this.. and added to it they are turning away from giving compensation too..
