Boundary wall collapsed just within an year of handover by builder
Q: Some portion of our boundary wall has collapsed only within 1yr of handover of building to apartment owners association. What is the liability of builder now? He says we have to get it repaired on association expenses only. What are the normal rules in such cases?
Thanks Mr Venugopal, but We have talked to builder he is not ready to get it repaired .He says he can provide technical assistance but not the cost.My question was initially that where we stand legally? what action we can take if he does not get it repaired?

It is definitely because of the poor quality construction materials used. Since the boundary wall was continuously wet it has gone weak. You will have to talk to the builder regarding this and ask him toe mend it.
There are two societies, ours with 150 flats & other with 1000 flats are separated by a rectangular empty plot which is deep .Our bldg is surrounded by a road & near the boundary wall are flowery plants which are watered regularly. Boundary wall has collapsed on the empty plot side .It seems there is no foundation made for wall.Only cement bricks were used to raise it & filled with earth & mud ,so between road & wall are plantations. It seems the wall could not bear the load of mud where plants were grown as other side on empty plot there was no support as being a deep plot.
