Hi, I have a question regarding deviation in a flat(Sai Sahasra in Avalahalli, J P Nagar 9th phase).
Q: The building plan with us shows that it is being constructed on two adjacent sites of 60x40 sq ft each. A well-wisher said that it is illegal to build one building spanning two adjacent sites. That apart, the plan says that there is a basement, a stilt floor, a ground floor and first and second floor. The ground floor(above stilt) has been made into four residential flats(originally meant to be commercial) each nearly 1050 to 1133 sq ft. The first floor and second floor have eight more flats. Finally he has started constructing a penthouse above second floor which is not sanctioned according to plan. Very little space has been provided as separation to the compound wall. I want to know what is the percentage of deviation in this property and which floor is safer to buy?
One lawyer whom we approached informally said there is deviation of 38%. What does it mean? Is it too high. I heard that in this project the number of kitchens should be eight but they are selling 12 flats. Actually in plan they have shown two separate buildings but they have constructed one big one.
Hi The builder is sahasra infratech. It is a four year old firm and this is their second project. Yes the project has got approval from deputy director of town planning which i presume is BBMP.
