Can anyone in this forum please guide me how to start cancellation process of flat legally. Also members of Balaji Residency Phase 3 Akurli, can we form a whatsapp group.
Yesterday H'ble Alibag court postponed hearing on anticipatory bail of other Directors of TBG and bail of Mahendra and Bablu till 18.06.2016. Court also directed to Police and Public Prosecutor to merge all FIR against TBG. Dear consumers, Investigation of EWO is till going on and they has to submit charge sheet against them. Then we will take further legal action. PICTURE ABHI BAKI HAI Dosto.
Even Padamavati Builders and Developers did promised this almost 2.5 years back. Now people who have cancelled there booking are struggling to get there money back. Mr. Vidhya Prakash an allied of Mahendera Pawan Kumar was absconding for couple of day. Praveen.

I, myself Amol Shejale. I had also booked a flat in Balaji Residency-II. I came to know about all this just now when i was searching for their website. Last two months I was trying to call Bablu and office and no one was picking up the phone. and now i came t know this. This is really shock for me. Please keep me informed about the developments.
Till date all Director's of Tirupati Balaji are under judicial custody. They are applied for bail and today we are strongly opposed to grant bail them. Next date given by H'ble Panvel Court is 05/09/2017. Kindly make UNITY that day.

Hi friends!!! I had booked a flat for my son on 9th Dec- 2012 through Tirupati Balaji Builders & Developers Pvt. Ltd. for their project ”Balaji Kalash” in ph-3 by paying 10% booking amount as asked. This was to be completed within a period of 2 yrs and possession promised during June/July 2015. I had been regularly visiting the site at Adai as well as their office but till last month neither the work has been started nor promises fulfilled by the builder on starting the construction work.
Hello Purva!!! We all are facing the same issue and our money has got stuck. More than 1000 booking have been done in this project as well as other 4-5 projects located within the vicinity of New Panvel. Builder has promised in January this year to start the project within 3 months or will refund the amounts collected as soon as possible. However, neither the construction work nor collected amounts refunded to me and many other cancellations done by the consumers. I don't know what will happen in the future.

All consumers of "Balaji City", S.No. 16/1a & 17, Vihighar, Panvel are requested to present at the H'ble Court, Old Panvel on 08.05.2016 (Sunday) for put up our grievances to the Court and extend PC of Bablu Gupta. I have a list of 86 consumers who have join us till date. If any person want to join us pl. bring their documents (5 copies each) for update information of consumers and finalised list for handed over to Economical Offence Wing, CBD, Belapur. All consumers who have not join on or before 08.05.2015 their names are not included in the said list. All consumers also noted that they have to bear some fund for fees of our advocate and expenses towards legal action taken various level. It is also noted that we are not given surety or guarantee to any body for refund of money form Bablu Gupta. But we are legally fighting by various action.
All victims of Tirupati Balaji Group are requested to lodge FIR against MD, Mahendra Pawankumar Sing and all Directors including wife of MD who is also one of the Director at Khandewar Police Station, New Panvel and handed over proof of cheating done by this group. Mahendra Sing is in Police Custody up to 11.05.2016 and Bablu Gupta up to 08.05.2016. Other Directors are not traceable till date. But at the earliest they will be arrested by Police.

hi Amol, first go and file police criminal case against bablu gupta. they are known as a cheater. Do not wait for their invitation. Project approval pending from since last three years not last one year. I am lucky that i took quick decision to withdraw the money before last two year and i received my all money. Thank God.

This Builder is cheater, he has cheated many people in the name of 1) Tirupati Balaji builders & developers 2) Aditya Builders And Developers Private Limited 3) Tirupati Builcon Private Limited. At the current situation, all have been absconded. This builder even might has taken a fraud medical certificate. A Strong action is need to be taken against this type of builders. Now it is learn from the other colleagues that Mr. Bablu Gupta after discharging from "NEER" Hospital will hold meeting at his Panvel office on 22.03.2016 at 4.00 pm regarding recent status of "Balaji City", Vihighar. Also he assured that Bhoomi Poojan will be conduct on occasion of "Gudi Padva". However, after inquiry at CIDCO that there is no any proposal from Mr. Bablu Gupta or TBG Director Mr. Mahendra Sing or Other Directors for development of the said project. Also learn from Sub-Register Office, Panvel to register sale deed of the said Survey No. 16/1a, N-17, Vihighar, Panvel in the name of Aditya Builders or TBG.
Now on site there is board of "Sagar City" in lieu of Balaji City, Vihighar, Panvel. Deal with Mr. Bablu Gupta has cancelled by Mr. Sagar Patil owner of the land and his is own carried out the project in the name of Sagar City. But till issue is pending whether Mr. Patil has kept customers who have already booked or return the money those want cancellation. Also pl guide me if Bablu has handed over or due to cancellation of his deal what about my booking? If Mr. Patil demanded extra money for my booking then what I can do. Because he can say if you want to cancel the booking and return money Mr. Gupt is responsible. From today Mr. Gupta is treasable.

Hi Rajiv, I had inquired about this project and its approval, i found that Balaji Dream City is HDFC, Standard Chartered and ICICI approved project. As far as project possession is concerned, it will be around December'2017.
Hi Rajiv, Instead of making call to them you should mail and ask for the current status. In this way you will get evidence of discussion which will help you in near future. or, you should visit the project site to check the ground reality.

Since Mr. Bablu Gupta not sitting in his office, not pickup the phone calls so many consumers are withdrawing their money. It is learn that Mr. Gupta has return money to them by SBI cheque due to his bank account at ICICI is closed by bank for "insufficient fund". Mr. Bablu also agreed that those are not cancelling the booking he will given written on stamp paper notified by Notary for possession in March 2017 he will pay monthly compensation to them. I don't know how I trust Mr. Bablu. Because he is not pick up my phone, not answer to my email or not meet at his office. Kindly suggested what action I do in this situation.

The builder Tirupathi Balaji Group is absconding with 100 Cr. and more than 600 people has under gone their trap though like you people. The scam is under investigation and not a single money will get He has started the builder business in different name like TBG, Aditya, Balcon etc..... Every one lost their money and he has arranged a medical certificate as Brain cancer patient from Fortis, Vashi for bail. Any way I've taken my money back.

I think you should study a lot before your investment as lot's of buyers are facing the same issues but at the same time you should find out the realty visiting the project site. May be someone wants to make the developer's image dull.

The land is plane still after 5 years. There is no construction work happening. People are waiting because they have invested while the property rate was just 2700/sq-ft. and now the current rate is Rs. 4500/sq-ft. If they will withdraw they wont be able to book another building with the same rate. It is also come to hear that they have not submitted the document to CIDCO properly.
Monica, I think you are from banglore as mentioned in your signature, I have very bad experiance of TBG group. I have withdrawn the money from the project. Nobody has made the builder image dull. It is actual situation.
Yes, in phase-2 &3 lot of flats are vacant. People are withdrawing the money from Builder. They can't even complete there existing phases. Already, lot's of people are struggling with this project. This could be a lesson for the new buyers, don't invest your hard earned money without checking the legal aspects of the project.
Yes, a new buyer should always prefer under ready-to-move property instead of under construction. You may face delay issue, loan EMI issue with under construction project. But in a ready-to-move property, you have only to pay the booking amount and rest of the payment as per slab basis.

Sunilji, What I have mentioned is current status only. The land is plane still after 5 years. We people are waiting because the money was them with for last 5 years amounting 5 lakhs. If we will withdraw we won't be able book another building with Rs.2700 rate. More over they are not ready to pay interest of paid amount. The builder also is delaying purposefully for his benefit. That every one knows. The maximum withdrawals benefit to builder by reselling the same on current rate ie.4500. But we people who were invested by loan and paying the interest over and above monthly rent. Bulder is enjoying and the investors struggling. He is not even submitted the documents to Cidco properly. Oncwe they have rejected and asked to resubmit. We are very much worried,

As a buyer, you should be aware of the protection that is available to you in the event of the late delivery of the immovable property you have purchased and also some of the things you need to avoid including in your contract.
In case there is a delay in a project and the builder is not willing to pay a compensation as discussed in the builder-buyer agreement, buyers can approach the Consumer Court or the civil court for the execution of the penalty and grievance redressa

It is right time to send a legal notice on consultation with a competent lawyer, clearly stating consequence on failure to deliver property immediately. If builder does not respond to the legal notice, you should either file a complaint in the consumer forum or file a lawsuit in the civil court against the concerned builder.
As per Consumer Protection Act, 1986, buyer can file a case with the consumer forum for a quick redressal of his grievances.

all projects comes under collector area and cidco giving only approval for construct the buiilding. mostly villagers staying nearby the projects and they will not allow cidco to allow that particular areas. It will take more time to get all facilities. there is no bus facility, only auto rickshaws and six seaters runs on sharing basis, roads are not wide, night travelling is not safe, general stores are not nearby, most of things are not available. so think before u invest. I think ulwe is better option that panvel.

The location of the project is quite good as you can find a hospital and school. It is also situated within 15 to 20 mins of the railway station and the airport. The amenities provided include a club house, power backup, swimming pool, lift, security, park, reserved parking, visitor parking, intercom facility, gymnasium etc.
Can you suggest any good project of TBG in New Panvel? What will be the price of 2BHK and its current price per square feet? Can you share some details and the payment plan of the project as well?
i suggest u that invest in 12.5% cidco project it is very safe to invest and no illegal projects. all facilities approve by cidco. all areas are reserved by cidco for school, garden, roads, and many more.
Hi Devika, Please, do not do any booking only on the basis of the brochure, some presentation or looking at a sample flat.
Make sure you visit the actual project site and see the location, how well connected the area is city, how are the roads, what is nearby the place and other important factors. A lot of people book properties in real estate expo and exhibition, which I do not think is a good idea at all.

What is the price they are quoting for 2BHK in Balaji Sneha Dham? I need some useful details such as payment plan and possession date? Are all the approvals are in place for this project?
Hi Shreya, If you are seriously looking forward to buy the property and want to get a good deal, then do not show your eagerness to buy. Hide that over enthusiastic and needy person inside you.
The agents/sales executives are paid commission on closing the deal and they will go to an extra mile to close the deal with you. Show them that you are not in hurry and your life does not depend on the property. Show them that you are a serious buyer who is not in hurry and if they have to win you, you will require a good incentive to invest money.
tbg all projects are not cuming under cidco. so the rates are low and negotiable. i quit from balaji kalash project. it is not yet started from last 3 years.

Today i went to their new panvel head office to enquire about the arrest of Mr yogesh Sharma director of T.Balaji properties.. Mr ashok was only in office & every body was absconding.. Mr Bablu gupta cannot be contacted neither Madam Sneha. No idea where they are as told by Mr Ashok the receptionist. He has given phone of Mr Alok Singh One of the relative of Managing Director Mr Mahendra Pwan Kumar Singh. Mr alok Told that this sunday 17th . they are organising meeting in Vashi for all the customers were all the directors of TBG group will be present. they were supposed to inform the venue details but till now No info is received from their side. Pls if anybody has the better details pls share with all of us.

Hi Mumnira, I can see that this project is delayed by approximately one year. In such cases, the builder is legally responsible to refund the amount paid with interest (for the period of delay) as there has been a violation of contract.
Your first duty is to sit with the developer and find out the reason of the delay. Sometime a project delay due to legal approvals. If there is a genuine delay then wait for the possession.
If you don't get any proper delay cause then send a Legal Notice through your lawyer to the builder. If still the possession is not granted, then file a case in the Consumer Forum for recovery of money and compensation for the delay.

When I asked to copies of property documents for my pre-approval loan, they denied by saying all documents will provided to everyone after 6-8 months. Is that a sign of fraud?? Hi Friends, I have booked 1BHK flat in Balaji Kalash Phase 1 in Feb' 13 and paid 20% amount. But registration is pending till date from the builder. Even construction is going very slow. Builder is telling the project is going to be affiliated by CIDCO and delay is because of the same. Do anyone have any other/correct information for delaying registration as well as construction.
There is no transparency in their dealings. They take booking amount even when plan / approvals are not in place and once plan is ready then they sell good/prime flats to new customers and give non-premium flats to first customers. So be careful while dealing with them. I have faced this issue in Balaji Residency. More ever if final approved plan is not ready then do not book as they change plans drastically. When I visited their office for Balaji Archade project, people there were saying all phases till phase 3 are sold out and they were taking bookings for next planned phase for which even draft plan was not ready. Hence I booked flat in Balaji Residency Phase 2, but when I went to take flat number after a month new plan was completly different & I was not allotted assured view flat. When I argued with the one who had taken first booking, person told me that all other flats are blocked even when I was from very first few to visit their office since plan was declared ready by them.
so many complained file against trupati balaji group, as they are selling without plan passed & even this group no have their own land in Panvel, how they are doing & how people trusting them ???? God Save them.

They will support you while you investing in there project but once you try to withdraw from the TBG project they will show you thier actul role. I have good experiance while withdrawing the money.
