Is there someway that we can get our EMD back from the builder in case we no are no longer financially capable of buyin

Q: We recently paid an advance including EMD to a builder. But due to some unforseen personal circumstances we had to use our money . Now we no longer are capable of buying the flat. the EMD was somewhere around 15 lacs. ANyway it might be possible for us to get some or part of that back ?

As per my knowledge, At the time of booking - Booking amount,
On or Before 60 days of booking – 95% of BSP less booking amount, 100% of (EDC & IDC+PLC+Car parking charges),
On offer of Possession – 5% Of BSP,100% of(CMC+IFMS+PBC+OTHER CHARGES+Stamp Duty & Registration charges),
Down payment rebate – 10% on (85% of BSP+100% of PLC).

Booking amount- 2 BHK (7.5 lac),3 BHK (8.5 lac), 4 BHK (10 lac).

This project is located in Sector-99 A,one of the prime location with good residential environment. Builder quoted price is around 6200/sq-ft. Expected possession of this project is around January 2018. Banks approving loans to this project are HDFC Bank, AXIS Bank,ICICI Bank, Bank Of India & Bank of Maharastra .

Yes ,Mr nikhil, you are right. According to me Sports amenities like Pool table, basketball, badminton, Jogging track, Gym, Swimming pool. Business amenities like Club house, Open Amphitheater, Card room & Party Hall.
And Earth quake resistance, Fire Alarm, Security staff.

EMD is refundable amount , you have to write a short notice (Letter) to get refund back.

To ensure that a Bidder does not submit a Dummy Bid or back out at time of tender opening, Government Department collects a small refundable fee from each bidder, which is called EMD. EMD is returned when all Bids are opened & tender is awarded. In case Tender is cancelled, the EMD is returned.
