We have been called for handing over of our flat. However, Lodha want us to sign a document that says that we have been provided the Flat along with all the fit up as per the agreement and we shall not be having any claim on builder of any nature in future. They have mention that customer shall check the flat and inform the discrepancies if any and the same shall be corrected by the builder within 30 days. They want us to sign this document at their HO in Mahalaxmi and after that only they shall provide us the keys. It is also to be noted that OC is not yet obtained and as per the builder it may take 7 months from now. whereas customers need to pay for all maintenance charges from now. This is not fair. I seek advise from other residents please. Please share your experience if any one of you have already get the keys and whether you also get it through the same process. Regards, Dixit
Hi all, If there is no OC, the municipal can also initiate action against the flat owners, as the law says no person can move into a building without the OC. Such cases have been seen in Mumbai and Delhi real estate markets. The classic example is the Campa Cola case in Mumbai.
Right Rajat, The law says one cannot legally move into a building unless the developer gets an occupancy certificate from the concerned department. The corporation can ask apartment owners to leave such illegally occupied flats or impose heavy penalties. It is difficult to get water and sanitary connection in absence of OC. 2) Financial Institutions insist on OC to sanction loan.
Hi, Did you check the flat? before signing any documents first check your flats whether it is as per the agreement or not. Is there any changes made in the said flat? Kindly share your experience with the builder?
Are you sure that the developer will handover the OC in 7 months? Check what is the reason of delay offering OC.OC is a must needed document for entering into the flat. If there is no OC, you have to face a lot of difficulties.

Yes Genevia is a tower in Lodha Casa Rio Project. there are many towers in the same project i dont know exact number of tower. you can reach to sales office for the price details.
Hi, A delay in giving possession can be due to various reasons such as pending municipal approvals or some dispute. Or if property prices are rising, the developer may deliberately not give possession in the hope of making buyers pay more even if the agreement has been signed at older rates. This will not reflect in the sale agreement.
I also booked a flat in Geneview A and now have received a demand letter with enormous charges that I should pay before the possession (for fit outs) from Lodha. I am surprised to see that they are demanding Rs.76,080 as Civic Governance Charges. I understand that the cost of all common areas and facilities are loaded on rates and also in difference of built up area and actual carpet area. I am not aware about this high charges of Governance charges to be paid by customer before the possession and for the entire period of construction. Also, the other rates are very high : 1) Legal Charges : Rs.20,000 (for what?) 2) Water & Electrical connection : Rs.40,000 3) Power Infrastructure : Rs.8000 (What is this?) 4) Club membership Fee : Rs.7000 (why before possession ?)

I spoke to my relationship manager and he clarified all my doubts. I have seen the Annexure !! of my sales agreement and found that all charges what Lodha is demanding and I mentioned in my earlier post is included. Hence, I have no complaints. I request others also to speak to their relationship managers and refer to the agreement for clarifications on issues. I feel that we customers do not pay proper attention to the documents during the deal and signing an agreement and then suffer. anyways, all the best and happy new year in advance.
However, as a real estate buyer, one needs to know when you are bound to pay these charges and when you should not:-
Under two circumstances the developer has the right to charge escalation cost from the buyer. Firstly, if the developer improves the specifications of the unit or adds better amenities during the course of construction he can charge the additional cost with proper notice to the buyer. And secondly, if during the course of construction, the cost of construction increases by more than 10-15%, the developers can charge an additional cost provided this clause is mentioned in the agreement.
Thus, it is imperative for the buyer to read the document carefully before buying.

I am from Genevia C the date given to me Feb 2015 actual agreement date is Feb 2013. So did you ask if he is delivering flat in December 2014 for Genevia A?

Buyers have little say in booking agreements. The penalties for delay in payments by buyers are mentioned clearly but charges of timely delivery by builders are minimize.Try to speak with them and ask him for compensation of delays in delivery. You will get your money back with interest for sure.
Ofcourse, there is a rule for compensation on delay project. Check the agreement first, is there any clause mentioning compensation on delay. If yes, then mail the developer or send them a notice mentioning compensation on delay. If they are not agree then consult a good legal adviser and proceed further.
