Q: is it wise decision to buy a flat without OC for the plot which comes under CRZ issue. Want to buy 2 bhk prutivi manisha paradise, roadpalli, Supposed to give the possession in Jan'15.But got the information that the building is ready since last 3 years, have lots of leakage problems, the property comes under CRZ issue will not get OC. Please suggest
Buying a house is a cherished dream and involves saving with your teeth. You won't even want to imagine a situation like the Campa Cola Compound. Therefore, be careful when buying one. There is no point in fighting the case on emotional grounds.
We should learn the lesson from the Campa Cola Societies unfortunately, the 100-odd flat owners of this society never got the OC, though the society has a clear title deed. So, selling or buying a house without an OC is illegal. Illegal constructions are rampant in Mumbai and probably in many other cities.
While CRZ-I pertains to places that are ecologically sensitive areas between 0 to 100 metres, CRZ-II covers areas that have already been developed up to or close to the shoreline.
In Goa, the coastal areas in Mormugao municipality and corporation of the city of Panaji fall under CRZ-II.
The areas beyond, between 100 metres to 500 metres fall under CRZ-III.
The new rules have particular significance for a coastal city such as Mumbai. It is estimated that nearly half the space over 200 sq kms that has been closed to development since the CRZ norms first came into effect two decades ago will now be freed up. About 146 slum clusters and 620 cessed buildings near Mumbai’s coastline can now be cleared away and rebuilt.
The new Coastal Regulation Zone (CRZ) rules of the Ministry of Environment and Forests that was notified on January 7, 2011, frees up more space for development which has been severely reduced under the CRZ rules formulated 20 years ago, by allowing development beyond 100 metres as against 200 metres in the earlier rules. But they give local coastal communities a say in how development should take place.
Under the 2011 rules, coastal land has been classified into four zones: CRZ-1, CRZ-11, CRZ-111 and CRZ-1V.
