Q: I am planning to book a flat in new venture under construction near to N Convention center (Auroville by Jain Srikar constructions, SY.NOS.27(P),29&32,KHANAMET(V),HI-TECH CITY,SERILINGAMPALLY(M),R.R.DIST.). I believe this land comes under Gurukul trust land but they have received approval from GHMC to construct residential project. Could you please advice whether it is safe to buy or not?
So even if this is not an illegal construction, you will have to pay some kind of a compensation to the Government later on if any legal issues crop up. Investing ina house is a big step, So I would advice you not to take up this property.
Hey, recently the CM of the state has said that he will give the Gurukul Land back to the trust it self and he has ordered all the ongoing residential projects on this property to be stopped. You should absolutely make sure that this is not an illegal constructin.
I dont really think that it is a safe option. You should probably see the other projects around and not this one. Earlier, before the regularisation was given to these applicants, the water and electricity of these all the properties was cut. There have not been any issues regarding tis property lately, but You should see another apartment building near there.
The Jain Aurovile hat you have mentioned are new in the real estate market and this particular project is their first project I believe. So you really cant be sure about them. Anyway, the possession dates for this start somewhere around June 2016, so I suggest that you wait till then and then purchase the property.
See I think that now all of this has been resolved as many of the societies and the people who have got the regularisation have got the permission from the Government. The GHMC approval should be good enough now as technically this land belongs to the Government now.
The government had issued GO No. 747 on June 18, 2008, framing policy guidelines on urban lands which were declared surplus and taken possession under the provisions of the ULC Act, 1976 in urban agglomerations for allotment to those already in occupation of such lands. When allegations were made that the trust was selling away the lands, the government withdrew the exemption. And then the trust’s lands became surplus under the ULC Act and were vested with the government. Individual occupants and institutions who had purchased the lands approached the government for regularisation.
This particular land is actually encraoched, but the government has decided that encroachers and other occupants of residential houses be let to stay there provided they had already applied for regularisation of their lands. Those who had not would have to be evicted, The money collected from applicants for land regularisation should be used to buy land in the vicinity and handed over to the trust in compensation.
According to the verdict given by the government, the lands of 2,787 applicants will be regularised thanks to the judgment delivered by the High Court, according to revenue officials of Rangareddy district and the urban land ceiling departmen
Yes, There was some controversy regarding this in 2012 I believe. But the thing is, the Government has allowed the residential units to be there if they have applied for the regularisation of the land. So I think you should confirm if this particular project has applied for the regularisation of the land or not. If it has, then it is safe to invest in here.
You are correct Praneeth. But I believe eviction will be done by GHMC people. In this case, GHMC itself has given technical approval so should not be a problem right?
Hey you are right. This project has already got the approval from the Greater Hyderabad Municipal Corp, So I think that this approval is enough for you to go buy this property. If it is approved by GHMC, then you shouldn't be facing any problems.
This Gurukul Trust land has got into some legal issues in the past few years. About 1,500 people who were in occupation of Gurukul Trust lands in Ayyappa Society and other societies on the city’s outskirts wereevicted by the state government. The Reason being they had not applied for regularisation of their sites.
