Q: Planning to invest in Oyster Living Divino project in Dahisar (East). Can anyone share their experience of dealing with this builder.?.Commitment fulfillment & reliability.
Please do not burn your hard earned money on this never completing project of Oyster Living. The builder is also not reputed. One year before I had made a booking in ELIXIR-II. But after talking to the people of the slum area I immediately decided to cancel the booking and even after one year I have not received the refund yet. They are not even responding to my calls and emails.
I have invested in Kandivali project and asked for the refund however since last 4 years , there are not doing any refund. is this forum can help in this?

I am saying so because project has not started even after giving booking amount three years back. The slum on the site is still there, talked to people living there, they are giving vague replies about the project.
I m saying so because for the last 4 years builder is making false promises. the project is stuck in litigation, i have heard so. Those who can wait for 10 years and more they can go ahead.

I have booked 2BHK flat in Oyster living in 3rd tower, as per Oyster team commitment they will complete the project in Dec 2020 but till now no progress on site. Still Slum is their and no any kind of movement. few days ago I have visited the Site office and they said after Diwali they will start demolition and move all slum people in Transit camp.
So now help me as I need to continue with this investment or I need to withdraw and invest in some other. Now they are asking me for down payment balance amount (20%).
Also they are committing they cleared Annexure2 and now looking for CC. But I am unable to see any confidence in same project.
Now they stop new booking due to RERA, they are not compliance with RERA act.

Last december only, I decided to quit , I gave a letter for refund of my amount. They promised me to refund the amount within 6 months. However till date, I have received only false promises verbally. Moreover, they want to earn by deducting 20% of the amount. Shame on oyster living and yes Mr. Cusyomer relationship Manager, can you tell me when will I get my hard earned money back.
i think all who had invested in Oyster living are cheated by the builder. The slum people are telling that they dont even know the builder and there is no plan for redevelopment . Sad to know that builder had taken hard earned money from you from last more than 2 years.

Got to know that the bio-metrics of the slum dwellers has not even been done yet. This in itself is a huge milestone as each and every slum dweller will have to prove that he/she is a original/genuine resident of the slums to the SRA authorities which would entitle him to a SRA apartment. The builder has been selling apartments in this project, for almost 2 years now, when nothing is confirmed!!! Its like trying to sell a cow's milk when the cow itself is not yet in the builder's possession! Interesting and amusing business plan! :-) It was amazing & perplexing to find out he has got so many takers!

I'm interested in Oyster Living Club Life project in Kandivali (W). I would like to know the credentials of the builder?
Whether they are reputed or not? Have they obtained the necessary permissions from the concerned government department / authorities to start the project. I read some users comments in this forum who have mentioned that the slums still need to be cleared. So I have a few doubts in my mind before I take a decision. I would appreciate if some one who has invested in this project could please share their experience. Thanks in advance.

Hi Mary!!! Oyster Living Club Life in kandivali West is offering with 1/2 BHK areas 638-920 sq-ft., price quoted Rs.6930+ floor rise, I think its a soft launch, I know it not the correct time to invest in soft launch but the price is tempting.
They have submitted the required document and waiting for the approval from Municipal Corporation of Greater Mumbai.

I heard this project will be construct on slum area behind your dahisar east office. I also come to know that resident of that area had no words with oyster people. Half of the property comes in PG (play ground) and road cutting. More than 50% people of chawl has no ownership land and even dont have proper paper work.
GST just increased the cost of the apartment by an additional 12%-15%...so now instead of paying 5-6% service tax you would be paying 18-20% GST tax. Increase by 5 lacs for 1BHK and 7-8 lacs for 2BHK!!!
GST is calculated on overall basis say for example s.duty is 5% registration is 1% and service tax, vat etc. so that will be clubbed as one tax..if you consider the impact of GST in real estate it will be not more then 1-2%..plz be well informed before commenting on any public forum

If you have already bought a flat but the entire payment has not been made, you will be charged tax at the GST rate on the remaining amount to be paid, which is likely to be between 12% and 18%.
The problem got compounded as stamp duty, which is levied by the local state government on the registration of the property, has not been subsumed in GST. Therefore, over and above service tax, the buyer will have also to pay a stamp duty of 5-8% in different states.
So the 30% down payment, for the apartment you book now, will attract a Service tax of 5-6% based on existing rate and the balance of 70%, which will in all likelihood be paid after the GST rolls out in April 2017 will be at 18% at a minimum (since this rate is yet to be fixed and BJP wants it higher then 18% while Congress wants to keep it at 18%).
Even if the GST is delayed by 6 months or 1 year, say April 2018, the buyer would still pay 18% on the balance 70% for the apartment as Oyster would not start construction by then. And it can only start asking for the balance 70% after it starts construction.

Hi everybody!!! My question is, how do you know that the Anexx Part is cleared? As anyone invested in this project. Is this project legal? Have you checked it yourself ? I strongly doubt about its possession by 2020 as clearing the huge layer of slums in next 5 yrs itself is a difficult task.
I am thinking of Oysters livings Kandivali project. they are saying annexure 2 proceedings will be starting in 2 months, project will start from 18 months and possession on june 2020. request guidance for the same. slum is still der they have started sample flat work and board of the builder is der on site.
Visited the site today! A big NO from my side. 2bhk Sample flat is fake constructed under trailer. They don't have 1BHK sample so I think real flat could be different from the current sample. They says cleaning of slums construction will start from April 2017. So 4 towers 40 stories each can never be complete in just 3years. Possession date 2020. They fake and says we have already sold 2 towers and 3rd one 25% sold. Okay so one tower residential floors starts from 5 to 40 floors so let's total one tower ka total booking money goes to 25.2 crore and if two tower are already sold then 50crore. If builder has sold two tower and have 50crore in his pocket then why there's no signs of construction. At least he can clean slums. So people would believe there's some work is going on. Final words if you are looking for just investment! Thumbs up go for it. And people who are looking to buy their first dream house. Please think a lot find better on going construction projects. Hi Friends, My name is Anand and I have been investing in real estate sector for the past eight years. First of all I have a question. Are we planning to buy for personal use or as an investment? If you are planning to buy it for PERSONAL use then it is a good buy as it is within mumbai limits. However for investment purpose it is a very good project as one has to pay only 30% as down payment and the rest in timely installments. If you dont want to bear the burden of home loan interest then this is a good option as the price of the flat remains constant from the time of booking and you have sufficient time to arrange the remaining part of the payment (5 years). Lets say that the price of 1bhk in dahisar is approximately 80 lacs, and the same is been provided to you by Oyster living for 40 lacs. By the time you get t the possession of the flat after 2020, I am sure that the said flat will value more than 1 crore in the market. Regards ANand M

Also, want to confirm weather they have obtained legal approvals from Government.
If Project is approved by legal Authorities and they are able to shift slums, it will be a best investment opportunity and will provide excellent return.

Point no 1 : it's an sra project comprising of rehabilitating more than 1000 existing slum dwellers . It will take atleast 2 years to do that and that too after they get permission to vacate them which will take at least one year . Point no 2 : total construction is around 10 lac sq feet plus ! It's a minimum 7 year deal if all things go smooth in clearances including the environmental policy. Point no 3 : investing long term also needs handsome returns . Are you sure mumbai is not offering other projects with lesser time in posession time ? Why wait for 7 years ?! We can't speculate what is going to happen tomm in terms of development in mumbai. Point no 4 : kindly appoint a legal advocate / solicitor to go thru the legalities . It will save a lot of headaches.

I have doubt about its possession by 2020 as there is a huge layer of slums in the locality and i don't think that it will be removed before 4-5 yrs. it is a big task. This issue insisted builder to sell their flats such a cheap rate. Visit the project site and see the ground realty. Money once goes will never come back.

I think Gautam is right. You should visit the site and check current work status before taking any decision. Don't believe on rumors. If all approvals are in place, will get your property on time. You can also share latest updates with other buyers that can help them.

Yesterday, I visited Oyster Living site to see the project and sample flat.
After visiting the site, when we called them for more information then they said all front view apartments up to 40 floor have been booked by 25 groups of people. So only side view apartments are left.
So how we can find whether this is really authentic information or only making buyer fool.
in sample flat, there is no pillar because it has constructed in the container but I am doubting that the actual apartment may be differ from the sample one.
If anyone can give me more information about this project, it will be good for me to take the decision.

The work will start after 2 yrs after shifting the slums into SRA buildings. It will take more than 5 yrs to complete. It is difficult to decide whether to invest or not as they dont have any papers in place.
Hi Avinash, You didn't mention your budget and project name. Budget play a major role in property buying. Never the less, Dahisar is well connected to the areas, such as Andheri, Goregaon, Malad and Thane through Western Express Highway. It also lies close to many areas in Thane. This way it boasts it connectivity to nearby commercial establishments in Andheri and Thane. This has contributed to the growth of real estate market here. Properties in Dahisar West ranges from Rs 12500 to 15000/sq-ft while Dahisar East offers properties in budget range of Rs 9200-12000/sq-ft.
Best option in Dahisar is Near SV Raod, Dahisar East. This is close to station and Highway. Dahisar is a Good option however Mira Road will be better compared to the rates and faster appreciation.
But i personally like to suggest you that before any investment, you need to compare the current market trend of the locality with current ready possesion rates, analyse the figures, forecast the price trends in the next 2-3 years and then short list properties worth investing.

Hi Keal, Even i am planning to book a 2BHk in it and had a conversation with the sales guy, he told me that rate of 1BHK will be Rs. 6500/sq-ft and for 2BHK Rs.7000/sq-ft. You have to pay 30% as down payment for 1BHK and 20% for 2BHK.
The date of possession will be Decenmber'2020 as per the sales guy.

I have been to sales office at Aditya Realtors. They have 1 BHK for 40 lakhs and 2 BHK for 57 lakhs, only when you pay 20 - 30 % down payment along with government taxes.

As far as locality is concerned, it is close to Sanjay Gandhi National Park, located near Western Express Highway, 5 mins walk from Dahisar Railway Station, hospital and clinics located within the radius of 2.3 kms, renowned schools & colleges are sited near the Oyster Living.

And the cost of 1BHK will be Rs. 39 lacs onward whereas a 2BHK will cost to you Rs. 63 lacs onward.
They are charging Rs. 25 from 3rd floor as a floor rise charges.

Hi Apurva and Savio, Earlier, we can judge a builder by its no of completed projects but now-a-days it has become very difficult to judge a builder's past reputation. Oyster living has successfully completed 6 projects but nobody know that they will deliver the 7th project on time or no. Only you can judge better than anyone else. Check all the legal approvals like IOD, CC, check is there any land issue where the project is going to develop, visit the project site, ask the local residents about the issue they are facing, the the connectivity and the infrastructure development of the locality, how far is the basic amenities like, schools, mall, markets, bus stand, eating outlets, hospitals, banks etc. from the project site. If all satisfies then go for it. After all it is a matter of your hard earned money.
