Is it Compulsory to register the property before taking the possession of the flat

Q: I have booked a flat in Raj Nagar Extn, Ghaziabad. I have the full amount of the flat to the builder. Now builder is saying that only after registration of property, flat can be handed over to me. I know that one has to register the property but it doesn't have to be before possession.

Hi Sameer,
Always remember, property registration is very much necessary. It is final complete agreement between two parties. Once registration of property is completed, then you are the legal owner of that property. Unregistered owners are illegal in front of law. Property registration is very much compulsory to prevent cheating & future problems.

Well, when you will buy an immovable property, you have to register it as per the law in nearest registration office by obeying all legal term & condition. After registration of sale deed, you will be able to obtain the legal rights of that property, on the date of execution of the deed. Under section 17 of the Indian Registration act, 1908 ,it is compulsory to register the property documents, while buying, selling, leasing or transferring a property.
