Khatha bifurcation

Q: Hello,

I have a plan of buying a property in Bannerghatta road in Bangalore.I spoke to builder about the legal documents .During the discussion i came to know that the land is A Khatha but since there are some slight deviations(not much ex: lift spacing) from approved plan during khatha bifurcation we might get B Khata instead of A Khata.But the builder says whatever the betterment charges that may be required to pay for conversion of individual flat Khaths to A Khatha will be taken up by him and the same will be mentioned in the sale deed agreement once I decide to buy the flat.Is it safe to proceed? He has all the recipits for betterment payments made and all the deeds.

Thanks for the reply Vaibhav.So you suggest not to go for property until he gets the OC?

That is Okay Tejas but because of this slight deviation the builder might not obtain Occupancy Certificate which is an important document.

No occupancy certificate means that the building has not been given a Pass Certificate by the concerned authority. As such, it does not have all the mandatory infrastructure or clearances that make the building inhabitable.
