Tower 25 Offer of Possession

Q: Received offer of possession for my flat in Tower 25. I am suppose to pay by end of this month, Jun and I have been told that I should have the key latest within 45 days of final payment. Do they stick to the plan or have delayed beyond 45 days in the past for other towers?

Dear Mr. Sanjay,Mr Ashwani singhal if you received possession for your flat and developer is asking about final payment and they are promising the key in next 45 days this stage is not very important and you cannot trust and make any financial decision driven emotionally, first off all you must ask for full Completion certificate not " Part" and Occupancy certificate, you can also use power of RTI to know the situation of Builder and Developer whether your builder/Developer is in the situation to give possession or not .There are Consumer court latest ruling over these issue.I suggest you to take expert /Professional in your side who can councel for you all buyer. Is it true that Phase-2 possession is expected in next 3 months.

Do not simply go on their issue of 'Offer for Possession' and also be aware that the delay charges that 'Paras Tieara' Sector 137 is offering is not as per the latest ruling for Consumer court and the delay charges that mentioned in agreement are no more valid.
The amount for maintenance charges is not justifiable, therefore be cautious the builder is trying to bind you for subsequent agreement i.e. maintenance and sub-lease agreement as per his conditions therefore refer to some professionals advise.

There is also a chance that the electricity and water connection could be cut if the owner does not have the Occupancy Certificate. A flat owner can approach Noida Authority directly.

As per law a flat owner can occupy the apartment only after he gets the OC, otherwise the building is considered illegal and can demolish any time by the local authority.

And you can not avail the home loan facilities in absence of Occupancy Certificate. If you are going to a bank for mortgaging the house, they will first ask for the valid OC. On the other hand, if you want to sell the property after a lapse of time, you will not be able to do so if you don't possess a valid OC or OC.

Moreover, the absence of a valid Completion Certificate/Occupancy Certificate mean the building may not have been constructed as per the approved plan, as it can be classified as unauthorized structure and you are taking the risk of demolition as we have seen in the Campa Cola Society cases.

Did you talk with the builder on OC? What is their reply? There must be some date by which the builder is obliged to give you occupancy certificate. If that date is there, talk about this to your builder. If it is being delayed deliberately without any reason, you send him legal notice. About his interest delaying the occupancy certificate, he may be looking for an opportunity to get additional money in one or other form.

I am agree with Hemant. And there is a supreme court judgement that clearly states that these documents should be handed over to the buyer, which reliable builders adhere to. But consumers need to understand that even reliable builders will show the OC-NC documents to perspective buyers and will hand over the copy of the documents after completion of the project.

Sanjay, I have also got a apartment in T25 and have received the offer for possession, but having discussed with Paras Tieara Representative he is unable to provide me completion and occupancy certificate which is required before possession and is trying to misguide by referring to completion certificate which is 'part', therefore I am trying to collect all those buyer's who have got offer for possession from 'paras tieara' and create buyer's group for further actions let me know if interested and email me on ashwaane@gmail.com
