I am Sumit Chadha, Got the possession letter for my flat from Pivotal Infrastructure in Dec'2017. I have booked the flat in Jun'2012 in tower no. 6. As per the contract after 42 months, the company is liable to pay Rs. 7.5 per square feet per month. But now at the time of final settlement, The pivotal management of Faridabad office is denying to pay the penalty for the delay for two years, as they are saying that it is applicable till the time when we applied for the OC, which happens to be last year. Nowhere in agreement this clause is mentioned.So please update if anyone known is there so that we can connect to stand against this. though pivotal people are saying that nobody is questioning us for this
Hello!! Check you agreement first. It will be clearly mentioned on it that you will get your flat possession after 3 years from the project launch date and 6 month grace period. If you bought your unit in the middle of the construction work then you can write a mail to builder mentioning the possession date and if you are not getting any proper reply then consult a property lawyer.
Hello Khushboo!! Did you visit the project site or tried to talk with the builder? I visited the site 4 months back, the construction work for Phase-1 & 2 has been almost completed, outside wall putty work was going on in tower 15 & 16. In tower 4,5,6 & 7 painting work (outside walls) was going on. I don't know what is making them to delay possessions for phase-1.
I am agree with Rajib. You should visit the developers' office or project site to get the correct information. If you are visiting the project site, you can see the construction status of ur flat as well as project possession date.
