Q: Approvals are not clear and if you will ask CRM they will terminate your booking and forfeit your booking amount as you are late to ask that or u have no right to do so
Hi Ashish, In case where a homebuyer or consumer feels that the builder has used his dominant position leading to disadvantages to the buyer, the buyer can approach Competition Commission of India to file a complaint against a builder for abuse of dominant position as per the Competition Act, 2002. The Competition Commission of India shall investigate anti-competitive practices of the builder and impose stringent penalties on the offenders in case they are found guilty.
@ In cases where the builders makes false promises to the flat purchasers and do not comply with their statutory obligations, the homebuyer or allottee now has an option to file a complaint under RERA or file criminal case in a Criminal Court against the builder along with the consumer complaint to be filed in consumer forum.
Dear Ashish Sawant, Sub Response to your post on Common Floor & Facebook dated 16th April, 2017 We had sent you the demand letter for Ruparel Skygreens on 13th January, 2017 of which the due date for making the payment was 31st January, 2017. Post repeated reminders & meetings to clarify your doubts, we informed you to make the payment soon. Even though all approvals are in place for your flat in Skygreens, you have failed to make any payment towards your flats. We even sent you a Reminder Cum Interest Letter on 3rd March, 2017 which you have ignored. Post your meeting with the CRM of Skygreens on 25th March, 2017 where a final time limit was given to you to make the payment which was ignored by you again. You had now taken 60 days & still not made the payment so we finally sent you a termination letter on 31st March, 2017. You visited the office after that for a final decision & you still dint offer to make the payment. Hence we terminated your flat & forfeited your token amount.
Dear Gitanjali, As per our terms, my payments are against IOA and CC milestones. Naturally I will have to see the papers before making the payments since you have sent Demand letters on those project milestones. Pls. Note. Your received LOI is dated 20 th Jan 2017 and You have raised demand 7days earlier on 13th Jan 2017. Didn't received anything on my verbal communication and I wrote your team on 3rd Feb 2017 and finally they sent approval copies on 17th March with almost 43day delay. On priority, I have studied all details, liquidated my fund with huge loss on interest amount to pay my dues. While studying project, "C" wing was not on any approvals and same query raised on 25th march to your team when came with intention to resolve my query and pay my dues. Your team promised to resolve after your Gudi padwa event on 28th march but they shook me with termination letter on 30th march. How anyone will pay his hard earn money on oral commitments. Pls understand from buyers mind.
