Car Parking Charges and GST charges. is it legal?

Q: Has everybody been charged and has everyone paid fpr the car parking? what about the increase in cost due to GST
Also, is the carpet area correct as mentioned in the brochure or agreement?
Has anyone faced any issue? pls share

As this project is under construction, residential construction services will invite GST at the rate of 12 percent, which will apply to developers selling residential units before completion of construction to the home buyers.

As per the GST (Goods and Services Tax) law, construction of a complex, building, civil structure or a part thereof, including a complex or building intended for sale to a buyer is a supply of service and hence, is liable to the goods and services tax (GST). You can claim for the refund via input tax credit.

Hello Nitin,
Under section 84 of the MOFA Act, every member who has allotted the stilt or the parking space shall be required to pay parking charges at such rate as may be decided by the general body of the society at its meeting, irrespective of the fact whether he actually parks his motor vehicles or not. The society can recover different rates for different type of vehicles and parking.

Although the parking charge is not necessary, yet every state is charging as per their rules. As far as GST is concerned, it is compulsory to pay if the project is under construction and if it is a completed project then you do not have to pay. But you can claim your GST refund online via GST Portal. The refund application has to be made in Form RFD 01 within 2 years from relevant date. The form should also be certified by a Chartered Accountant.

Hi Nitin,
As Tata Amantra, Kalyan West, Mumbai is a MAHARERA approved project and its RERA Registration number is P51700000308. So, the mentioned carpet area in the brochure or agreement is correct. RERA approved project is a symbol that indicates that the builder has followed all the state rules and regulation and there is no dispute in the project.

I am also owning a new flat in Tata Amantra, builder is asking me to pay the GST on the other charges like (Electricity, Legal, MMRDA development, Betterment, Interior deposit) on which the're imposing 18%,
