convert BBMP property to commercial in gated communty

Q: I have a plot (with the house built) within a gated community on the main road which is open to public and the road is a connecting road between neighbouring layouts. The road is become a very busy road, and noise and has no longer viable for resident purposes because of the noise. I have been trying to rent it out for the last 2+ years but unable to get tenants because of the exact reasons mentioned above. I live outside the city because of work reasons and cannot occupy the property myself.

The association says the property cannot be converted to commercial, with the given situation this cannot be rented out nor can we sell the property. I believe BBMP has given approval for other properties outside the layout (in the same road) for making them commercial.

Please advice what are the rules around BBMP to get the property converted to commercial and what takes precedence over the property BBMP or the association.

Appreciate any suggestions.

Interested to know if there was any progress on this? How did you manage to resolve this with BBMP? Please advice.

Hi all,
Apart from that, the district or deputy commissioner, or collector, who is authorized, may permit conversion of land if satisfied that the prescribed conditions have been met and there are no pending dues or litigations on the property. The conversion should also be permissible under the master plan of the area. A conversion order permitting the change in land use will then be issued. Also, a conversion certificate will be issued.

The fee charged for the change in land use is to be paid as per Rule 107 of the Karnataka Land Revenue Rules 1966. The fee varies for different districts and locations in Karnataka.

Hello Anil,
In case your state allows this, it is necessary to get an approval from the housing society before the conversion of residential property to commercial property. Depending on the nature of the business, it may also be necessary to obtain permission from the local municipal authority for the conversion of a flat into a commercial establishment. Once a property is marked as commercial property, it would be treated as a commercial property for all purposes, which includes paying more as property tax.

Yes, You can convert agricultural land into residential or industrial land by paying a fee. You can get a 'change of land use' after obtaining the necessary approval from the local authorities. You have to apply to the commissioner of the land revenue department, explaining the purpose of conversion. Along with the application, you need to attach certain documents such as ID proof, mutation letter, original sale deed (or gift partition deed), latest tax paid receipt and certified survey map. There is a fee to get the land converted, depending on the nature of the property and its location.
