Q: I have bought a 2 BHK flat with a stilt car parking. Builder charged 2 lakh additional for stilt car parking which is included in the registered agreement cost. Car parking allotment with number mentioned in the agreement. Please advice if it's sufficient to claim ownership on this stilt car parking under the new rules and regulations for sale of car parking.
Latest Answer: In 2010, the Supreme Court had ruled that open or stilt car parking area cannot be sold or treated as flat or garage and sold to individual flat owners, but at the best be treated as common area. These spaces are part of the common areas in flat complexes and not saleable independently as a flat or along with a flat. If builder is further insisting for additional car parking charges then file suit in the consumer forum.

Latest Answer: Don't pay any additional amount for car parking charges. And if builder is insisting then drag him to consumer forum or can suit a case against him. Car parking and open terraces are a part of the society's common areas. They are not a part of the Floor Space Index (FSI). Hence, the builder has no right to charge any money for this space.

i have a 8 gutha land which is suitated in nallasopara ,dist thane maharastra.which comes under vasai virar municipal coroporation region. i have sanctioned a redisential plan from my plot and was sanscitioned by cidco on 2007 .after 3 year i havd revised my plan to commerical when vasai virar municipal corporation came under exitence under town planning in 2012. my plan was sanctioned and i had started construction on that plot when i got commencement certificate .the plot comes under commerical belt on development plan by town planning vasai.after sometime i got letter from talisher asking for Change of use in land form residential to commerical...i was unaware of that i have to change the land use by collecter .does town planing has a right to give permision to construct buildig without obtaing permission for collecter ,or can you please advise me what should i do .i havnt converted my non agriculture land form residential to commerical ? i am ready to pay conversion or
Latest Answer: Hi frankly speaking that , the to convert a standard residential property into a commercial property is going to depend upon zones. Also, there are few pointers that you need to keep in mind before transferring the land : * Is there sufficient parking * NOC from neighbours properties * Road Traffic should not be affected. For a better help, you can also appoint a local town planner..to assist you with the application.
