Delay in possession and no compensation by Lodha

Q: The possession has been delayed by Lodha over 18 months and lodha is telling that all under the sun are to be blamed for the delay and they cannot pay interest for it. I have lost it benefit for the last 2 years on the hefty home loan and also paid rentals...can I proceed to consumer forum?

Hi Everyone..Need your faadback..i am new to mumbai and looking to buy a flat as a end user stay somewhere closer to ghodbunder road..yesterday i visited lodha splendor site n was quite happy with the area and the amenities they provide(as explained by sales executive)..But after looking at all your posts i got disappointed..Could you please provide feedback if it is worth putting all our savings out in lodha splendor?...also let me know if you have any good properties aware in an around ghodbunder...

Hi, there is no doubt that the construction is very good so is the amenities. However if you ask whether there is a fair play by lodha, i doubt so... Atleast for me where i did not default any paymnets to lodha, the agreement is clearly onesided in favour of lodha. The provisions for compensation will come to force only when god comes to earth. So if you want a good property and ready to wait for an year or two more and without any compensation then, u can go with lodha. Please be prepared for the delay of atleast 24-36 months from the committed date.

I am facing the same issue. Despite of all the delays and not getting the possession Lodha is not ready to remove the restriction for removing the lock-in for selling the Flat till possession so all intent is to take the return our money at 12% with us bearing all the losses and then make money by re-selling the Flat.

I have recently reieved communication from Lodha for Teirra B wing that possession has been indefinitely postponed and that they are willing to repay whatever I had paid towards the Consideration Value with 12% simple interest. This means that I will lose out on the monies I have paid towards MVAT, Service Tax, Stamp Duty, Registration and not to mention the 2Lacs they took in cash towards Car Parking. Moreover the money that they repay me will not be worth much to buy another house since the property rates have skyrocketed since I booked my flat. I really don't know what to do now!

My husband booked one apartment in 2009 and from then... same story: delays due to various reasons. Yesterday we went to main office in Mahalaxmi and we spoke to one of the managers. She informed us that the building will not be completed before 2014 (which I really doubt, as the construction stopped at 10th floor and the building should have 28 floors!) and the only thing we can do is to wait. When we asked about the compensations which should be given as per the contract she practically admitted that the contract has zero (!!!) value.
Come on, people, you and me invested lots of money, we can't let them fool us just like this! Let's fight together and if there is justice in this country, someone who has the power will make justice.

Hi Melania - I'm shocked that Lodha managers has been advising you that the contract has zero value. As per folks I know, They have been charging them for Splendora on heavy interest rates at 18% percent on any delays in payments. Also, if someone lost a job or in event of death, they forfeit 10% of the flat cost citing CONTRACT terms. Lodha very loosely uses the contract terms based on their needs and makes an absolute fool of people.
I've also been told, customers that are bold enough to send across legal notices to Lodha and filed lawsuits, have been compensated outside court. No reputed builders of such large visibility stoop to Lodha gutter practices.

Hi Krishna, I have heard that in few more projects also Lodha has done the same thing.. projects have been delayed for long and the builder is not even providing compensation..
