The Karnataka Chief Minister said that the government plans to take stringent action against those errant builders flouting building bye-laws by not providing home buyers with an Occupancy Certificate. Thousands of home owners are facing a similar plight of not being provided with an OC.
Documents required to obtain Occupancy Certificate are as follows: 1) Commencement Certificate, 2) Completion Certificate, 3) Built plan along with section plan, elevation and site 4) NOC from fire force, Karnataka State Pollution Control Board 5) An approved and signed sheet of the floor area calculation by the architect 6) Pictures of the completed building 7) Tax assessment with tax paid receipt 8)If solar panels and rain water harvesting done, submit photographs 9) Sanctioned plan copy.
If there is no OC, the Palike can also initiate action against the flat owners, as the law says no person can move into a building without the OC.
Is it really important to obtain Occupancy Certificate because I am planning to buy an apartment where the builder is not giving Occupancy Certificate.
Now-a-days many builders do not bother to get OC and often home buyers move into a flat in hurry burry once the construction is complete. But, it is very much important to know when you are handed over the keys of your new house as you may face serious issues later once you move in.
Hey Hardik, in such cases make sure you check the Commencement Certificate (CC) before signing any agreement. Usually builder continue to build first and second floors without getting a CC which is illegal and later can create problem in getting an OC.
Do we need to ask for the occupancy certificate to the builder while booking the flat itself ? Do they have separate one for the entire building and for a specific flat or its just one ?
No one is allowed to occupy their flats until and unless the builder provide me Occupancy certificate. Occupancy certificate is mandatory and you have to check with the builder about the same before booking a flat
Hello...as far as i know in completion and Occupancy Certificate, no person shall occupy or allow any other person to occupy any building or part of a building for any purpose until such building or part has been granted the occupancy certificate. Every owner/ lessee is required to submit a notice of Completion cum Occupancy Certificate of the building in the prescribed form and such notices shall be submitted in the proforma along with the requisite documents, fee and charges mentioned therein
Occupancy Certificate is mandatory before you can start living in an apartment. It is illegal to occupy a flat if the document does not exist for that building. The Builder has to get the Occupancy certificate from the Municipal Corporation. It is a legal permission to sale the flat after which customers can buy and occupy them for living.
