Builder is not giving penaly charges of late possesion for two years of Amrapali Castle. What should we do
Thanks Mr. Singh for your reply. I am completely agree with you. As per agreement the possession has to be given in July 2012 with the grace period of 3 months i.e. till October 2012. As per penalty clause in the agreement should give 10/- per sq fee per month. But inspite of sending 3 request to release the said payment, no body is responding from Amrapali.. They have offered passion in June 2014 only and possession is delayed by 20 months.
you first write to the builder asking for payments certificates, that will give you fair idea regarding progress of construction matching schedule and then file a consumer complaint. If the builder does not provide you with such details, still you can file consumer complaint and seek this information in the proceedings.
Hi Vishal, Delays in construction of residential projects are common in India. Developers include a grace period, generally six months, in their agreement with buyers. Most homebuyers take a delay of 6-12 months as granted. Sometimes, possession is delayed even beyond the expected tenure. in my view please go through your agreement paper and review once and let me know from what is the exact delay tenure ?
