Q: at the time of of booking company sale person told me that company have a scheme name subvention in this scheme company can pay all bank interest of bank loan till possession . at the time of agreement possession date is December bt project is delay . now company tell me that company pay only interest till December because he already mention in tripartite agreement that assume possession date is December . sir what kind of legal option i have now ? i have also a hand written document of company employ which show that emi start after possession. kindly guide

Latest Answer: Yes, you are right Abhishek. Builder is trying to cheat him. A subvention scheme in which the homebuyer pays 10-20% of the price of the apartment at the time of purchase. The balance is paid by a bank to the developer as a loan under a three-way agreement between the developer, the buyer and the bank. While the project is under construction, the developer pays the interest on the loan to the bank. The bank disburses money to the developer as construction progresses. The buyer's EMIs begin only after he gets possession. So, i will only suggest you that plz. don't pay any interest to bank or the builder.

Q: Name written on 7/12 is of first seller who has done the plotting of land sold plots to individuals.
1) Is NOC or approval is required from first seller if I want to sell my plot?
2) Do I have to pay any charges to first seller?
3) Can first seller stop me for selling my own plot?
Latest Answer: I have purchase plot in 2011, is there any govt. taxes applicable till today's date, if yes is there any provision to pay it online.

Latest Answer: Apart from that there are certain essentials that make the selection process an easy and productive one. 1) The age of the property should ideally range between 1-5 years to a maximum of 10 years. 2) Know about the reputation of the builder and the quality factor associated with his past developments. 3) Understanding the reason behind the sale will help in uncovering the problems and issues with the property, if any. 4) Considering the surround environment, proximity to important areas and amenities available in the vicinity also affects the final decision of purchasing a resale flat.

Q: We are staying in apartments where we have only 9 flats. Since, we have only less than 11 flats we might not come into co-operative society laws. We are registered under apartment condominium. The flats were approved for usage of residential purpose from the concerned municipal corporation. One flat owner has given his flat to a person who will be running software consultancy business from his flat. There has been resolution passed in one of the AGM, where flat owner cannot give flat for commercial activities and need to provide copy of police verification to managing committee. All members expect that flat owner have agreed to it. This office will have more than 10 employees working within it. Also, opening of office will affect the security, peace and harmony of other flat members. Please advise us what option the managing committee has to stop the office operating from within residential apartments.
Latest Answer: A person is allowed to run a professional office in one/more of the rooms of his residential flat. Profession by definition is Doctor, Architect, Lawyer or CA. At times even artists are allowed to perform their services such as photoshoots. Even engineers are allowed to offer their services. Software Consultancy Business is a tricky thing as it is part of services and hence stands on a thin line between sale of goods and services. It depends on the memorandum of understanding of your apartments. If voting takes place in your apartment you can take a vote on this and make an official complaint to the nearest police station and to Municipal Corporation as an apartment. Even being a member of an apartment you can lodge a complaint in your personal capacity. But when the case stands in court, courts will go by the merit of case. Its not an easy case to fight though.
