Q: what are the docuements that we got after purchasing flat from builder in Mumbai and please Arranage in squence? you can add document that might be there in the below list.

e.g

1.Agreement to Sell (details if any )
2.Sales Deed
3.Possesion certificate

Latest Answer: Hi, When i bought my property in 2010, i consult a property lawyer and he gave me a list of documents that i needed to furnish from the builder, he checked them and gave me a written opinion that the documents are in order and hence i can go ahead for buying. These are 1) Sale Deed, 2) Latest tax paid receipt, 3) Mother deed, 4) Encumbrance Certificate, 5) NOC from fire fighting dept., forest dept. and airport authority etc., 6) sanctioned building plan, 7) Title Document, 8) Approved lay out plan, 9) Conversion Certificate, 10) Commencement Certificate, 11) completion certificate and, 12) Occupancy Certificate.

Latest Answer: Hi Sanjay!! Ask for copies of all necessary permissions prior to making any financial commitment. Check the following documents and clearance certificates to avoid getting into any legal mess in future: These are 1) Land record documents, 2) Construction clearances, 3) Approved lay out plan, 4) Land use certificate, 5) Master plan of the area and, 6) NOC from multiple department.

Q: What all documents should be checked before buying a property and what all agreements should be signed at the time of giving the token amount and agreeing on the payment terms? Please help.

Latest Answer: While paying the token amount you should ensure that the following documents are in place: a receipt for the payment made, a sale agreement mentioning the token amount, a construction agreement mentioning the period, schedule and stages of construction. A four partite / tripartite agreement if you are going for a bank loan, the bank will have a checklist mentioning all these. Regarding the legal documents you should consult an advocate before you proceed. Because even though the basic documents are same, some papers vary from project to project. An approved project with a bank means the project has clear title.

If so, check that the title of land ownership is free and clear.Check the building byelaws as applicable in the area to make sure that there are no violations of front setback, side setbacks, height, etc. -Check specifications given in the agreement to sell to ascertain whether the builder is providing the same as promised. -Conduct a thorough background check of the builder and his reputation. -Ensure that developer has obtained all the necessary NOC's from the respective authorities such as urban land ceiling NOC if applicable as well as NOCs from the electricity water and lift authorities has been obtained.
