Check you agreement first. Is there any clause for compensation on delay possession. If yes, then mail the builder and ask for the compensation. Keep the mail copy for proof. If you are not getting the proper reply, then consult a property lawyer.

True Chintak, HDIL promised possession by 2010, but most buyers claim they have not been given possession. In January 2014, around 400 buyers protested the delay at HDIL's head office in Bandra (E), and in February, a flat owner filed a written complaint with the police after talks with the company failed.
I m promised the possession in march, but the work is going on and i m very sure that they will delay the project. If you are ready for any kind of delay then you can take the risk. I m waiting for my flat since last 2 years
That is why i always advice the buyers to buy ready-to-move property. It is always safe. The price is little bit more but you will get your possession as the registration process complete. I am giving you a simple example. Suppose, whatever you paid the builder in those 3 yrs. if you made an FD, SIP and ELSS, you will rewarded as a 5-6% as a interest and In ELSS, you will get the benefit of Tax redemption plus 8-9% as an yearly interest.
Right Hari, And in those 3 yrs whatever the property value may increase in that locality, at least they can earned qtr. of it as an interest. And the difficulties you have face after the invest, at least you could take a good sleep.

Well Khalid, Several flat buyers, who have paid the builder for the flats, are in a similar situation, after the developer called them to his office and informed them that they would only be given possession of their dream homes after paying the additional charges.
Several homebuyers, who booked flats at Premier Residences in Kurla (W) in 2009, are protesting against the builder’s unreasonable demand of extra charges. They were assured of possession in 2010, but 4 years later, they are still waiting. i also heard that they are giving possession in June'2015.
Please suggest any action that we can take? Should we pay further money or stop paying till they give us CC above plinth and NOC from Central Bank. Banks have stopped disbursement of loan (earlier they were sanctioning but now they have even stopped sanctioning).

I have been getting regular demand letters for my flat in Building No. 4 and can confirm that slab no. 6 has been reached for the same.
However for building number 3 which includes the wings ABCDE can see maximum progress on building A while the digging work for building E was going on.

Hi Khalid, Couple of days before i spoke with builder executive, i got to know that, construction is on full swing. Expected possession will be around Jun 2015. This project has approval from Axis Bank, State Bank Of India , IDBI Bank, LIC HFL & Punjab National Bank.

They aren’t ready to give us any sort of documents, which only means something is wrong here. I think we should take the advise of a legal property adviser for further step. After all it is a matter of our hard earned money.
Now they are saying that the project possession date will be Mid'2015.
Thanks for the information, Vishal as I also asked similar question earlier. In that case how do we pay HDIL as personal finances are limited. Also, they are sending demand letters by late payment interest. If there is no CC, are we liable to make payment even from our own sources?

HDIL in Premier Exotica has commenced construction above plinth without receiving Commencement Certificate (CC). The construction without commencement certificate is not legal and still they are asking money for that. What should we do? Should we make payment? My Bank is not disbursing without the CC, saying it is not legal.

An FIR has been registered by the residents of Premier residency (Refer Mumbai Mirror dtd:7/4/2014) but will it affect the shameless people. In our agreement of Premier Exotica, possession date was given as June 2013, later in an advt. the date was given August 2015. there is no communication to us regarding the change of possession date as if he (builder) does not bothered. The way the work is going on we don't think we will get possession by 2015.
I have received pictures of the Premier exotica site today and looking at these pictures i can confirm that no work in progress at Exotica. I have pictures taken on December 2013 and now March 2014...I dont see any change.

forget jun 2015, even 2017-2020 if get possesion we will lucky, The way constraction is going on, their work is completly stop, they are not pay money to the contractor,i think they are bancrup,they want money for nothing, we have to be very careful before paying.Primier exotica launch in jun 2010 now almost 4 years.

I have recently visited the site to make the payments for the third slab at Premier Exotica. The work is very slow and seems it will take longer time. It seems builder is taking us for a ride. The sales executives were giving the hint of extra payment for the flower bed as per new DCR rules.. Chetan"s suggestion to get all on one plateform may give us some relief. Any One From HDIL Premier Residence ? Builder has hold the further possession and asking for the payment of extra areas for balcony/grills as per new DCR. I have a flat in H-Wing and waiting for the possession and when I visited their Sales Office at the project site itself they give this information.

Hi Chetan, you have flat at premier exotica or Primier REsidency ? if exotica than than no way to get possession on 15 feb2014, still they are on 2nd slab or 3rd floor.slab.Any we have to do some thing, their non of project in Mumbai is complete, all project having problem, we have to invite all people e.g Andheri (W) Metropolis) and so many project all are pending.they are realy giving hard time.

guys i too have a flat in PREMIER EXOTICA , Is there any way all meet up at the site office together , final possesion date , if possible create some chous and try and get it media . making the hdil's life hell . may be this can help . Going the legal way wont help
Generally Builder charges transfer fee in both the cases whether agreement is done or not till society is formed. After that the transfer is done by society and transfer charges need to be paid to society.
Hi Shaikh, the builder is going to charge some amount of money from your profit to transfer the name, If your flat is not registered and you want to sell your property to some one else. On the other hand if your flat is already registered and you have paid the stamp duty and registration then you need not have to pay the builder anything
As on date 27/07/2013 Work is going on in full swing in both Phase I And II. For Exotica A/B Wing First Floor is almost ready. C/D/E basement Third floor work is going on. For Building 4 Work is almost reach to Plinth level. SRA work is fully stopped. Internal road work ( Conctrate ) is going on in Phase I.
The possession of Premier Residence is going on but at the same time the leftover work is also going on. They are constructing a concrete road for residence. Last wing of residence is yet to complete.
Dear Shaikh, For last 4 days I am continously writing mails and calling corporate office for response to my Queries. Today I spoke with secretary of Residential Sales VP after dropping a mail and she informed me that if it was mentioned in the Agreement? If not then you should have read the agreement before signing. I Informed her that we were given the copy to sign only at the REgistrar Office then how can we read before signing? I also asked her if you go by agreement then why you are not complying with the posession date mentioned in the agreement which is delayed by more than 2 years.

The SRA contract is terminated by MIAL. The SRA work is stopped fully. but Free sale compnent work ( Phase I & II is going on smothly. The SRA town will be a ghost town till some outcome came. HDIL is expected to approach legal court asking for compensation.
SRA project is un-certain but too close to Free sale FSI project. The incomplete building will not only look ugly and not maintain than create a problem if used for illegal activity (which is known in kurla ). But i think HDIL is clever enouph to sort out the mess. They will get a jackpot if allowed to sell SRA in open market.

Today the maharastra Govt clear the MIAL airport devlopment project. The slum on eastern side of airport ( Kurla, Kural Side) SRA plan is cleared by govt. they definatly need HDIL to shift peaple to its SRA project. They will re-negociate the plan in this devlopement.
Free sale FSI project are independent of SRA project. But devloper need to give pocession of SRA project first than free sale project. They will find it difficult to get OC from BMC without fufilling this condition.

I too recieve demand notice for plinth work yesterday. The language is dirty and autocratic. Asked to pay in 3 days. But since the work is going on smothly and builder too need money to continue work in speed. If we want project completion in time then we need to pay amount in time other wise more delay will happen. I will be contacting builder in few days time. anyway work will slow or halt during mansoon(3-4 Month)

Dear Friends, I have also invested in Exotica. This week i have received a demand for payment of the installment for completion of the plinth work. They have asked to make the payment within 3 days which is ridiculous after having to wait for 2 years to reach this stage. I am quite concerned though to make any further payment since I hear that they are almost on the verge of bankruptcy. I do not know whether I will risk my investment further by paying an additional amount. Have any of you received such a demand. Have you made the payment? What do you feel about the risk?
Ive been talking to 2 executives at bandra and kurla.. both are giving different possession dates. from what i could gather, possession will be given end of 2015. btw they are now open for agreement. currently quoting approx 11500 pr sqft now.. but if u are an old investor trying to sell off then you wont get anything more than 8-9k pr sqft.., btw hdil is also charging approx Rs800 pr sqft for transferring the flats.. they are literally robbing investors in broad daylight..

even Phase II we have booked in sep,oct 2009, and pocession suppose to be Dec 2012,it's already more than 3 years,still we don't know how many year it's going to take.Another 2 year means even Phase II also 5 Years or more.
5 Year is a avg pocession period in mumbai at present. All the major projects are delayed. So HDIL is no exception. But once they start in full swing then they can complete work in 2 - 2.5 year , if work without intermediate stoppages.

The demand note for Plinth is dispatched long back ( Around Sep-Oct 2012), They are not doing any followup but at that time the plinth was not ready I had pointed out this fact to them which they agree and said to pay at later date.
I had visited site yesterday(11/04/2013). The work going on in full swing at premier exotica building no 3 .The work of The Plinth is completed for AB wing & The basement work ( 4 Parking Floors) of C D E wing is presently under construction. The need to complete major work before mansoon otherwise it will not be possible to continue work during mansoon. All nearby SRA work is going in speed . The work of Building no 4 ( All 2-3 BHK flat) is started from 15 days ago. The basement work is underway at building no 4.

I never said that poccession by Diwali. I only say that underground work is not possible during mansson so they are sppeding it. Looking at speed of work it will take atleast 2 more year before flat are ready for pocession. soory to disapoint you.

I had visited site on Sat 02-Fab 13. Work is smothly going on on Exotica site Around 20-25 persons are at work. AB Plinth work and digging work of CD wing is under going.I also had few photo which i will upload soon. All the work at (SRA, Phase I )Kurla are going on smothly. If this rate of construction continue than you may expect complete building in 2-2.5 yr time. You need not worry Such delay is very much a part of real estate work in mumbai.
Their is no good news from HDIL, all project in Mumbai of HDIL are On HOLD,They are not paying money to Contractor, Even exotica we have same issue,even after 2 years noting happening,guys pl can you chk what option are available if they goes bankrupt.
good news...good news....today i visited the site.work has started 4 days back ..jaysukh patel is the new contractor for premier exotica.at present they have started work on A AND B WING..excavation for other wings has also started.around 100 workers were at the site.hope the work goes on till the project gets completed..

Builder only give wage reply. They said to me that the work is going on in exotica. When i said their is no worker at site. that they said today worker might not come. This was some 1 month back. Work is completely stopped at exotica.

i had been to the site yesterday.no work in progress.they are completing the pending work of premier residency at present.regarding exotica,i was informed that it will start only in early 2013,may be in feb-march.
At present the SRA building work is going on. Phase is getting ready i thank it need another 4-5 month to complete it fully. Exotica work is fully stopped. The contractor is not paid so he had left the work. good news is that a new road is coming between complex and Railway line connecting vidyavihar station and santacruz chenbur link road ( Close to Lokmanya tilak terminus.)
I dont think there is anything happening there...i was there on site last month and there were only 2 men working, looking at the pace fo work, I reckon it will be atleast take 2 more years for possession.
