Q:I have done all the formalities with HDIL and for loan with Dewan Housing Finance Corporation and my loan is already approved and check is also ready with Dewan Housing Finance Corporation but they ( Dewan Housing ) need clearance letter from Central Bank of India from which DHIL have taken loans against this property to clear the check. Now since last one year we are trying to get the letter from HDIL and their management and staff is giving promises only. And thus we are not able to get this letter and thus possession of my flat. At the time of approval of loan the HDIL also took around 5 lakhs from me as a taxes and charges saying you have to clear this first and apply for loan. Now I am living in Saudi Arabia and cannot come everyday to follow the case my brother is following with them but he is also tired now. what option I have and what can I do now is anyone to help me out..please...

If you don't see a sign of possession in near future and if the delay is beyond a reasonable limit, you should file a legal case. You can file a case in consumer court or file a civil or criminal suit as the case requires. Get a legal opinion though before proceeding.
Latest Answer: I have ofcourse made several attempts to contact the builder however they are very slimy from the top to the smallest of employees and if confronted say as Umang Joshi but he too doesnt turn up even when asked for meetings.
If you delay a single payment the builder slams 21% interest.
Now this Umang Joshi is sitting with all the peoples money and not giving any answers.
Gave fake slab completion letters and collect entire payment.
His staff specially one Indrani's sister Archana by name has been telling people to pool money and complete the project themselves...
So this post is 1 for awareness of the general public and 2 for proper advise from experienced people.
Can I take the builder to consumer court ?
Arup Rajan appreciate your comments on Ready to Move etc however it is equivalent of telling a sick person that they had the choice of not being born.
Q:The builder refuses to give clear reasons for the delay. There is no time-frame for possession. If you have also bought a flat (like me) and are suffering from this unreasonable delay, please email at kohinoor.phase2@gmail.com. Together we can fight better.

With regard to your issues I think you need to take the issue with court and settle the matter. You can also solve the matter amicably with the builder if he is willing to. But in case the builder is not willing, then I think you should approach the court for this. The court will take legal action against such builders.
Q:There is no work happening in kohinoor city over last 4-6 months bldg no 17 in phase II.... Does anyone have any details for same.... The answers from the kohinoor team is very vague.
