Q: For Casa Univis (or is it now Splendora?) Egnis E, I once again got a call urging me to take Fitout possession. They are not offering any information on OC and consequently the final possession except to say that they have applied for it. But they are trying to get more money out of me by offering fitout possession.
Also, on CAM they are saying that it will start from Jan 15, 2013. When I don't have possession of the flat how can they expect me to pay for maintaining it? Also, they have not addressed the issue of doubling the maintenance charges from what was agreed upon.

Also, when I asked them if the clubhouse, pool and other infrastructure is ready, they haven't answered in the affirmative. These, by the way, are what this maintenance charge is supposed to be going towards. So, basically Lodha expects the buyer to pay for maintaining infrastructure that isn't ready yet and that the buyer doesn't legally have a right to use.
Latest Answer: Virkram, Rajesh is right - all the hill top clubhouse, cluster club house was marketing gimmick - they are the marketing genius - you have to give it to them. As far as the plans, brochures - there is one beautiful "*" that says terms and conditions apply. These terms and conditions state they can change the other plans without notice .. bla .. bla.. so technically, its difficult to prove them on wrong in a legal suit. In certain cases you clearly can - like delay , but one has to be prepared to take on the fight and put sustained efforts.

Q: How many people have taken fitout possession? Is there any information about it?
The builder is saying that OC will come in about 6-8 months. What is the point to taking fitout possession other than paying the builder the full amount?

Why is the builder charging CAM from 31st, October? My understanding is that as long as the builder doesn't given possession (full possession where I can live in the building) they have possession of the property and therefore any maintenance is their responsibility. How can this be transferred to the buyer without giving possession?

Q: i am MR VARUGHESE. I have a booked a 3 BHK Flat at OPTIMA TIERRA . I am an NRE in the Gulf. I have finish my job and by the end of OCTOBER i will be comming. I have no were to stay so kindly let me know when i will get my possesion of my flat it is on the 13th floor. This is my only hard earn saving. Please give me your feedback.
Latest Answer: You will be lucky is they get permission to build by 2013 .... and if you get possession by 2014-2015, that also looks like a dream knowing lodha group's reputation ..... i have also unfortunately invested here and spending on rent

Q: I have a flat in Tierra cluster. Recently, my 'Customer Executive' contacted me saying that they have entered into corporate agreements with banks such as SBI, HDFC and others and convinced the banks to release payments. Even though they have permissions only till 4-5 floors, they are demanding money from people who have booked on higher floor. I wonder how they can do this? How can banks, sanction loans in the first place when they knew that permissions were not complete? And how can they disburse money through some private agreements? This seems to me like banks and the builder are in cahoots and we, ordinary flat owners will be skimmed. Does anyone have a different view? What can be done in this situation?
Latest Answer: why on earth should you disburse and pay interest to the bank when they dont even have the permissions to construct. You should plainly refuse payment/disbursement and we should form a group and fight out the illegal penalty for any delayed payment. They cannot demand (leave alone charge interest for delayed payment) for something that they dont have permissions for.
