Occupation Certificate Issue

Q: Hi, I have bought a flat in Navi Mumbai and I have not received the Occupation certificate. The building which was constructed come under the Coastal regulation Zone. What are the implications of it ? The building was constructed in the year 2010. Would we ever get a OC. What can we do now?

CRZ rules are the bane of builders, who tend to find construction potential in every square foot of the city regardless of social and environmental costs. Unscrupulous ones try to pretend that CRZ doesnt exist by building on land that should be free of construction.

I am telling you why the residential development is restricted in CRZ. CRZ area means- water area up to 12 nautical miles in the sea and the entire water area of a tidal water body such as creek, river.

Clearance shall be given for any activity within the Coastal Regulation Zone only if it requires water front and foreshore facilities. The following activities will require environmental clearance from the Ministry of Environment and Forests, Government of India. Residential buildings, office buildings, hospital complexes, workshops shall not come within the definition of operational requirements except in very special cases and hence shall not normally be permitted in the CRZ.

HI Sachin,
Without OC, the building is technically unfit for occupation and hence in the event that any accident takes place, the occupants / users of the building can hold no one liable and would not be eligible for any insurance or compensation claims. Water, sanitary and electricity connections, if already obtained, are liable to get disconnected.

You can talk to the builder to get OC or else refund of money without any deductions.

Is there any similar flats nearby? Ask the owner of that flat whether they have received the OC or not. Try to visit your local Municipal and ask for the remedies. Because according to the CRZ rules, no OC has to be given for residential or commercial purpose if it falls under 100 meters from the High Tide Line.
