Q: my builder is giving possession letter but it is mentioned possession for furniture. and people are sifted there. is it legal
Latest Answer: Hello Raju, Certificate of Occupancy or completion certificate is a document which is issued at the end of the construction by a local government agency or planning authority. The document is a proof of the building's compliance with applicable building codes and other laws. A flat owner can occupy an apartment only once the OC is issued, as per law. The OC also plays a significant role while applying for home loan or loan to purchase a resale flat.

Q: I am about to get possession of my flat from AFNHB Airforce Naval Housing Board. Builder is telling me to register the property prior to giving possession.
Is this legally permitted
Latest Answer: In India, builders cannot compel buyers to register properties before granting possession. As per the Real Estate (Regulation and Development) Act, 2016, builders must obtain occupancy certificates before handing over possession.

Q: have purchase 1 BHK flat mohan greenwoods. still possesion is halted due to OC certificate. It's more than 1 year after promise date of possesion in aggrement still I am waiting.Also they take 2 lacs for NOC , if you wants to sell your flat. just sucking money from money.

Latest Answer: Hi All, This is Tushar again. Recently I got a call from Mohan Groups. They have resolved all my quires regarding delayed OC. Now OC is on the way . Just a matter a 3 months from now I guess. Although I am getting late possession but must say that Mohan Group Construction quality is excellent. They have provided amenities like swimming pool, library, club house ,gym and party area, tennis court. small play area for kids, which are very good. All are very good. I am fully satisfied with the quality of work. Although late but it's worth. Also as far as the legal documentation is concern,it's all clear and good from Mohan Greenwoods.

Q: My builder has applied for an occupation certificate. He had received an CC on 2009 but did not receive an OC. It was said that the building came under CRZ. How do verify the genuinity of the claim.
