Q: What are the property documents required for a Gram Panchayat approved flat in an apartment?

Latest Answer: Hi, 12 important documents required for buying Gram Panchayat approved flat. These are - a) sale deed, b) mother deed, c) building approval plan, d) commencement certificate, e) conversion certificate, f) khata certificate and khata extract, g) encumbrance certificate, h) betterment charges receipt, i) power of attorney, j) latest tax paid receipt, k) completion certificate, and l) occupancy certificate.

I had bought an apartment in Asten Viveria at Thengod near Kakkanad.
The project was promised to be complete by 2015 and was delayed by the builder.
Now i.e. in October 2017, the builder is asking me to take over the apartment for which registration is incomplete, authority water and electricity is not completed and occupancy certificate from local authorities have not been obtained.
Is the builder right in his claim to handover apartment without these legal or official documents? Can a aggrieved customer refuse to take over in such instances?

Latest Answer: No, do not take possession of flat in absence of completion and occupancy certificate. It will consider as illegal and some basic amenities will discontinue by the local body. A building, of which possession has been obtained without taking OC, can be demolished at anytime. If builder had completed building as per sanctioned plans completion certificate would be issued by the authorities.

Q: This whole building received an eviction notice from Human Rights Commission in July 2017.. Municipality summoned about 30 establishments were functioning in this building. None of the offices ( residential apartment ) do not posses any legal papers to rent it out for commercial activities. each flats are rented out as office space will not be able to file for professional tax or any other for that matter. as on First of August 2017, This building is facing critical maintenance hassles and power and water issues. DO NOT OCCUPY THIS SPACE ON RENTAL, until the guidelines are followed and receive the clearance from health department of Thrikkakkara municipality and clearance from Human Rights Commission. Please read all documents carefully before signing agreements. save yourself from fraudulence personals imposing as resident association officials..
