Progress of the Land Acquisition in Kochi

Q: Hi, I am interested to know more about the progress of all the land acquisition works that are going on in Kochi. Is there any progress legally on this direction?

I am from this area and I am of the opinion that a letter sent by DMRC to KMRL stated that the estimated cost of land per cent is Rs. 35 lakh and the total land proposed to be acquired is 46.4 cents. The acquisition cost is estimated as Rs. 16.24 crores. But the Kochi Corporation secretary in a counter affidavit filed in another case stated that the amount fixed for per cent is Rs. 14 lakh.

There is also another important thing that you need to know. The court said that the petitioner has to pay the Advocate commissioner, an amount of Rs. 50000 as his remuneration. The petitioner also has to bring the Commissioner to the spot at the earliest.

I think that the court has said about the acquisition that the amount received by the property owners will be without prejudice to the compensation payable under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Re-Settlement Act, 2013. This would be a good move in my opinion.

Oh yeah..in fact 80 percent of the total amount would be disbursed forthwith to the petitioners after executing the necessary agreements. The state government also pointed out that the beneficiaries should produce title deed of their property to receive the interim compensation.

The locales were not to be taken lightly. They had a plan in mind before. The petitioners wanted the government to comply with the Act while acquiring their land for development projects and were hoping to get the best out of the deal.

You know why the court said that it was because the petitioners said that they were entitled to the benefits under the Right to Fair Compensation and Transparency in land Acquisition, Rehabilitation and Resettlement Act 2013 in addition to the market value of the land.

Did you know,..the Special Tahasildar of the Metro Rail Project said that the market value of the property in addition to the equivalent sum as solatium would be paid to the petitioners. The state government also said that the estimated price of land per cent is rs.15 lakh.

I think that the KITCO had already assessed the value of the properties, no? The Commissioner should verify the aspect and he has been directed to file a detailed report in the court.

Right now, the State government has informed the court that estimated price of the land came to Rs. 15 lakh per cent. The government also came up with an exact plan of action on the way they are going to pay.

I don't thinl the localites will not be cheated. They should stop with their oppositions. Special Tahasildar, Metro Rail Project submitted that market value of the property in addition to the solatium equivalent to the value would be paid to the petitioners.

I think that the acquisition proceedings for the ROB project will be going on as scheduled. The high court of kerala also appointed Mathew George Vadakkel as the Advocate Commissioner. He will be conducting a local inspection.

Did you know what the court say? That it was reported that the KITCO had already assessed the value of the properties. The court asked the Advocate Commissioner to verify this and to file a detailed report to carry on further with this.

You know while admitting a batch of writ petitions filed by various land owners in the Pachalam area challenging the eviction orders that were given out earlier, the judge also appointed Mathew George Vadakkel as Advocate Commissioner to conduct a local inspection.

Justice V. Chitambaresh was the one chairing on the issue and he issued the interim order while declining pleas by the land owners to stay the proceedings which were initiated by the state government for acquiring land for the project.

The Kerala high court has finally given its nod for the concerned authorities to go ahead with the land acquisition process for the Pachalam rail over bridge project after this news generated a lot more unwanted attention and drew oppositions from the locals.
