Q: I M A SMALL PROMOTER. IN MY UNDER CONSTRUCTION BUILDING IN HOWRAH KOLKATA I HAVE SOLD A FLAT @2000/SQFT.BEFORE 31.03.2013 BUT NOW THE VALUATION OF THE FLAT IS COMING AT 3200/SQFT. SO WILL TH BUYER HAS TO PAY STAMPDUTY ON 3200 OR 2000. AND THE PROBLEM IT WILL CAUSE TO ME

Q: Hi, what are the upcoming projects by Avani Group in Howrah? Please share the review about the developer.
Latest Answer: Avani Group has done a commendable job in most of its residential projects. One of the best things I liked about their company is that they have not jumped mindlessly in all segments. So far they are focusing on residential apartments. They plan to turn to commercial segment in the near future but that means they are giving a dedicated approach to each project which a great plus is considering the number of developers in Kolkata today. The downside is that they are not pan India and hence sometimes do not evoke user confidence but I have heard good reviews from people in Kolkata about them. Yet to hear a bad user experience.

Q: Hi
I am planning to buy a resale property from an investor. Investor didnot get possesion and already paid 90% payment.So there will be tri-party agreement between Apointer(investor) , me(nominee) and builder (owner/seller) .What are the key clause I should check as buyer in the agreement?

Latest Answer: Hello ..there are certain points to be careful about before signing an agreement. For example Check that all figures and any other information inserted into the agreement are correct or not, make sure the agreement clearly states the rights and duties of the parties, if there the builder does not deliver the project on time there must be a clause of penalty etc.

FLAT HOLDER ARE WANTED THE EQUAL MAINTENANCE & DEVOLOPMENT FEES FOR ALL.BUT I THINK THIS IS WRONG WAY.THE MAINTENANCE SHOULD BE CALCULATED BY SQ.FT.NOW PLS SUGGEST ME THE RIGHT WAY OF MAINTENANCE FEES.AND ALSO CONFIRM ME IS THERE ANY RULE ABOUT THAT?PLS MAIL ME.

Latest Answer: Write a letter to Managing Committee regarding the same and request for general body meeting where minority group of flat owners' interests are protected. You can consider complaining to the concerned Registrar of Societies in this behalf. This is not advisable, and must only be resorted to where every other avenue of dispute resolution has failed. Seek help from legal expert.

Latest Answer: Each apartment will have a model bye-law which clearly mentions the method of calculating maintenance fee which is considered fair and acceptable to all members of the society.
