Latest Answer: Yes, they have implemented their own RERA Act which is known as WBHIRA (West Bengal Housing Industry Regulation Act, 2017. The notification of HIRA formalizes the confirmation with RERA, a central Act aimed at bringing in transparency and reliability in the housing sector. Now, all housing projects above 500 sq m or eight apartments need to be registered with the state regulator.

Latest Answer: When you go for registration of your property, ask the list original copy from the registrar office. They will provide you the original sets of documents.

Q: The tenant is not staying in the premises but has inducded others,and they too are not paying neare my legal action against these occupiers, can i evict them then how ?

Latest Answer: Hi, Send your tenant an Eviction Ramification Notice. If the cure time in your eviction notice expires and the tenant has not paid, you must be ready to go forward with a court eviction. If you are unfamiliar with the process of evicting a tenant, I highly recommend you use a lawyer who is experienced in landlord tenant eviction cases.

Q: We booked a flat in Kolkata that is due to be handed in early/mid 2018. However, the location feels far to us now & we want to go back on the deal. The contract says the breach would amount to some Rs.50,000 penalty.

We have paid 7lacs till now & ready to bear the 50k penalty.

My question is, will this be a smooth process or is there a chance for the builder company to cheat us or extort more than 50k? Just looking for any experience/advice on the matter before I approach the builder company regarding this. Any helpful response is appreciated.

Q: I have purchased a flat in behala, majlish ara road. Promoter provided completion certificate copy from kmc duribg purchase. When we approached kmc for mutation, tge officials are telling the apartment is on one part of land, but total land is 10 kattah more for which we need to submit any deed or so from that land owners. Promoter is not able to give it and kmc is not processing the mutation or trying to put personal liability tax. Can we not process mutation for our part of 15 kattah land for which we have all papers? Also what is personal liability mutation for kmc?

Q: I have booked a flat in Dum Dum area, Kolkata, 7 months ago paying 20% of the sale value. At the time of booking I was informed by the developer that the land is not converted (from agricultural to residential) and also no mutation has been done from BLRO. However, I was informed that these would be done in due course of time and before I apply for housing loan with banks.

The status right now stands that the mutation has been done but conversion has not been done and the developer informed that he will not do so and I have the option to cancel the booking. Also, when I approached banks for housing loan, reputed banks like SBI refused to provide loan in the absence of conversion papers. However, there are some banks and financial institutions which are ready to provide loan without conversion papers and some have in fact already approved the whole project.
Now the question is: 1) Is it advisable to go ahead with the property or cancel the booking?
2) If I go ahead with the property, would there be a problems in future (like for flat registration, flat mutation or anything else you are aware of)?
3) In future will it be possible to resale such property without any problems?
