Q:The promoter had had handed over the flats towards the end of 2011 and the Apartment Association was formed in Dec. 2011. Despite repeated mails/calls the promoter is withholding the original land documents with him on one pretext or other. What is the legal position in the matter.

Thanks Ms. Priya. Before we could contemplate action as suggested above, the Promoters on Oct. 23, 2014 had sent the documents through the representative for being handed over to the Association. The documents have been received under proper acknowledgement and are presently in safe custody. Thanks again for the valudable advice.

Latest Answer: It is very sad & unfortunate, till today (23rd August 2011), STP Plant in SIDHARTH NATURA, Medavakkam is not ready for its use. Bad smell coming out from the Sewage Treatment Plant affecting most of the residence and also neighbors. Promoters started doing different tactics to convince the Association, Owners & Residents instead solving this problem

I bought a flat on Mar 2008 and still I'm paying only the interest of my Loan, as they didn't hand over the flat yet. When I enquired the status about the completion by last June, they said by Dec 2009, it would be completed. Slowly they postponed every month, now the postponment had turned out to be weeks and still they never change the word of "Postponement".
Its better you buy a flat outside, to have a tension free life.

10) Design of Electrical Distribution and points / switch boards are very bad
11) Lot of problems inside the house kept unattended
12) Allotted Covered Car Parking (CCP) area is not uniform and small for few peoples
13) Outside decoration, lightings are only for show to promote future projects and get bookings

I am one of the worst affected Flat Owner of Sidharth Natura. I strongly advise all future Aspirants of Sidharth Dakshin and Other Projects be very cautious and not to haste in enter into a Construction contract without clear penalty clause with interest for all / any type of delay in completion & hand over. Also, please ensure size dimensions of all rooms and in very particular Covered Car Parking size / area are clearly mentioned in your contract. Otherwise, you will become one more unfortunate owner of Sidharth Flat.
