Completion Certificate in Faridabad

Q: Hello All,

I am looking to buy a single unit flat, 2nd floor in Sec-49 Faridabad. Area of the flat is 123 Sq. Yards. 2nd Floor is not as per the sanctioned map, hence builder has applied for the Completion certificate after paying some penalties.

From last 3 months, builder is saying that process of Completion Certificate is on hold and it will open soon.

Can anyone guide, if it is a single unit flat, then why there is problem?

Also, can I get the registry done, without completion necessary.

Hi Prabhat,
Nationalized banks will not fund such project without OC/CC certificate. Approved plan for the building is only 1st floor, and if your flat is on the 2nd floor then the 2nd floor becomes a deviation and a gross illegal structure, the corporation can demolish this illegal structure anytime. It will not affect your purchase of the flat on the 2nd floor.

Hi Prabhat,
All the gentlemen have given you the same reply. OC /CC is the mandatory document to occupy the premises once the construction is completed. You will not have marketable right and title over the property unless obtained the same. And OC would be considered as Driving License to run your vehicle.

A buyer is entitled to get an Occupancy Certificate on signing the agreement or before moving into the apartment. However, often builders do not acquire the certificates from the local civic bodies and hence are legally compelled to pay property tax. In addition to its importance, in the absence of the Occupancy Certificate an apartment owner is often deprived of basic amenities like-water and electricity.

If building has no Completion Certificate it would imply that building had not been constructed as per sanctioned plan. And as you have mentioned above that 2nd floor is not as per the sanctioned map. So, Municipal Corporation can demolish unauthorized construction. Don't purchase the 2nd floor flats.

Jashan is right Prabhat. It is an authorized building. So, don't waste your hard earned money. And i am hundred percent sure that the builder will not get the Occupancy as well as the Completion Certificate. You can not register your flat as the Completion and Occupancy Certificates are not in place.
