Q: Hi All, I have booked flat in officer city 1 (Ready to move) and as per builder we can shift in the flat after full payment and he will give us possession letter on same day. Can anybody please suggest me that any builder can shift without OC and CC approval.
Latest Answer: Builder has no right to delivered physical possession without getting the OC. However, some builders only to save the penalty amount offer the possession, which totally against the law, buyer can lodge the complaint against them. Regards Sunil Tiwari, Advocate 9717161215

Q: I have purchased a flat in Kasba under Kolkata Municipal Corporation, and already made 50% payment. But the builder is saying he cannot give completion certificate. Now he is threatening to cancel the agreement and selling the flat to someone else. What to do? Please advise

Q: Hello All,

I am looking to buy a single unit flat, 2nd floor in Sec-49 Faridabad. Area of the flat is 123 Sq. Yards. 2nd Floor is not as per the sanctioned map, hence builder has applied for the Completion certificate after paying some penalties.

From last 3 months, builder is saying that process of Completion Certificate is on hold and it will open soon.

Can anyone guide, if it is a single unit flat, then why there is problem?

Also, can I get the registry done, without completion necessary.

Latest Answer: Hi Prabhat, Nationalized banks will not fund such project without OC/CC certificate. Approved plan for the building is only 1st floor, and if your flat is on the 2nd floor then the 2nd floor becomes a deviation and a gross illegal structure, the corporation can demolish this illegal structure anytime. It will not affect your purchase of the flat on the 2nd floor.

Q: Hello,


I have been to Karia Orchid and liked the apt. 2bhk ~58L. It fits my requirement too, ready to move, within budget.

My only concern is water. I am told by the sales person that they provide tanker and it's common in Wagholi as there is no pipe line connection. He was willing to provide me contacts of their Exotica project residents to check with them if they ever faced any water problem.

Can anyone already staying in Orchid please share the water situation.
What about drinking water ?

He can file a complaint before the consumer Forum. He can file a complaint before the Competition Commission of India. He can approach Regulatory Forums. He can file a Criminal Case.

Q: The builder was supposed to give possession in 2014. The project is in re-development, existing tenants and new owners, The builders has already built 5 slabs yest to build 3 more slab
Latest Answer: Hi Deepak, The Supreme Court has held that a consumer has the right to approach the Civil Court or the Forum under the Consumer Protection Act for relief in a situation where the builder commits breach of his obligations.
