Wiout QC and CC certificate we can shift in flats?

Q: Hi All, I have booked flat in officer city 1 (Ready to move) and as per builder we can shift in the flat after full payment and he will give us possession letter on same day. Can anybody please suggest me that any builder can shift without OC and CC approval.

Builder has no right to delivered physical possession without getting the OC. However, some builders only to save the penalty amount offer the possession, which totally against the law, buyer can lodge the complaint against them.

Yes you should pay an Extra GST on the property now after possession, this should be discussed with the builder before buying.

It is better to buy properties from a reputed Realtor like Godrej Prime Nova or Prestige etc to avoid such problems in future they will be setting all the things in place from paper work to GST and make your buying journey easy

Hi folks,
According to civic norms, flat owners cannot live in a flat until it has been given an OC from the building proposal department of the BMC. Anyone occupying a flat without an OC is liable to be prosecuted. Buildings without OCs are not given a water and electriity connection and are charged a higher property tax.

I am agree with you Sharath...during property registration, occupancy certificate is of no account, which often leads a buyer to work out on the opinion that this authorising document is wide of the point.
In addition to its importance, in the absence of the Occupancy Certificate an apartment owner is often deprived of basic amenities like-water and electricity. Having an OC is a must to apply for home loans, while buying a resale flat. The essence of OC can also be summoned to the fact that for new under-construction flats, banks provide loans only when the Occupancy Certificate is submitted.

Hi Prabhat,
It is illegal to move into a flat or house without receiving the occupancy certificate. A buyer can move into his or her new apartment only once the occupancy certificate (OC) has been received. This occupancy certificate is generally obtained from Ghaziabad Development Authority and it is mandatory for every residential complex, which is larger than 5 units. In absence of Occupancy Certificate, local body can disconnect your water and electricity connection anytime.

Yes, If a building has no OC, it would imply building had not been constructed as per sanctioned plans. Municipal Council can demolish unauthorised construction. Banks are reluctant to give loans to flats in buildings which do not have OC and CC. It is difficult for owner to sell such flats in buildings which do not have OC.
