Q: Hi, I bought a house in Navi Mumbai/Panvel area back in 2010 and have not lived in it for a single day. I want to know if I have to pay the society maintenance charges in this case? What are the legal consequences of not paying the maintenance charges?
Thank you and best regards,
Sunder
Latest Answer: Maintenance charges has to be paid irrespective of whether the property is used by owner, tenant or left vacant. Every society will have its byelaw stating its maintenance charges and penalty for non-payment. In your case, I recommend you can communicate with the assocaition or society concern member and come for practical solution

Q: Hi, I heard there was some court case filed regarding Munirka Enclave maintenance charge issue? Do any of you know what happened exactly?

Latest Answer: Most of the RWAs operate in areas developed by DDA and handed over to MCD for maintenance & care-taking. MCDs roles is primarily restricted to sanitation and road maintenance & upkeep. They provide support on horticulture, but in most cases, this is handled by RWAs themselves. Also the level of service on sanitation & road maintenance is pathetic. Similarly BSES is in charge of electricity & DJB for Water, service levels of both of which are also questionable. RWAs liaise (read: relentlessly pursue) with these agencies and in addition provide Security (Guards, CCTV, etc.), Gardening, Hygiene, in addition to organizing community welfare & social programs. Costs of all of these need to be borne by resident members (whether owners or tenants) and RWAs need to be supported by a legal framework. The Apartment Ownership Act (58) of 1986 stipulates these provisions for owners/tenants and RWAs alike. However, it is not clear whether the same has been notified & implemented by the Delhi Govt.

Q: In our apartments 15 houses are there, 14 are occupied, 15th house in II floor is kept with the builder for the past 12 years. Being a builder he is keeping some items like windows, pipes, frames taps etc, once in a month or qtrly his persons come take the things and go. He is using it as godown, neither he is paying maintenance nor sharing expenses for the common props maintenance or purchase like Motor, Weathering, Tank repair, flooring, common drainage pipe change, common manholes, all of us would hv spent almost 25K to 30K, this guy runs construction business with his law certificate, talking too much not paying any money, we hve formed association also, how to make him understand that atleast pay 20,000 for corpus fund so that expenses are shared and our burden is reduced
Latest Answer: Hey Niketan, Is the apartment society registered? If yes, you can go to court for further steps.
