Q: Respected Members/Admin, I am in badly need of advice, please help and guide.
I have a flat at Kolkata (under KMC), my bathroom ceiling is having severe leakage problem, whenever the residents above my floor uses their bathroom my roof is flooded with 200/300 water drops. When I requested the resident at my top floor to rectify, they are saying it is not our issue but your, you can do anything at your roof. There is no proper legal community though I pay 30,000 annual maintenance,
Please help :
1. Is there any legal option to handle this?
2. Who is at fault (resident above me/ promoter (build 3 years old and possession certificate mentions promoter owns no responsibility)
3. Can anyone suggest me next steps please.
Latest Answer: Hey, leakage issue is a common problem for both the residential owner, as leakage is connected with both the owner wall and it damage both units. My advice is to take some legal adviser from local advocate.
