Q:Builder has not informed residents that he has formed Apartment Owners association. He has a receipt book that says Saras Apartment. Is there anyway flat owners can find if Apartment is registered or if builder is just fooling us? Builder does not call meetings, he collects money but never gives details of expenditure and he does not take opinion of flat owners before spending money, Builder holds the accounts and he just tells us to contribute 5000 Rs or 30,000Rs and flat owners have to give money. What can owners do?

Q:I have a query. Can a building with 7 flats form a society? Or is it mandatory for 7 flat building to form an apartment? My builder has a flat in the building and he has not formed society or apartment in 10 yrs. Renovation of your flat without consent of your Housing Society or Apartment Owners Association is illegal. An Apartment Owners Association in any state may be registered under the Societies Registration Act. Every society has its own set of bye-laws, formulated within the frame work of the Society Act, for the state concerned. All members of the association are bound by the bye-laws. No addition or alteration of existing flat in an apartment can be done without the consent of the Housing society or Apartment Owners Association.

Latest Answer: Now, one more thing, you know, as the builders do not complete their work on time, the banks with which they have approvals do not allot the loan amount. This is because, the banks allot fund only after the completion of each phase of the project. Such a problem is worst for the NRIs, because most of these flat owners are NRI's and they visit Kerala once only in a year. there is difficulty in monitoring and following the construction process. I also agree that there should be a monitoring authority for this.
