Q:As per BDA a minimum of 10% land in a apartment project should be set aside for park and it belongs to government. Can builder construct a club house in this land and provide restricted access to apartment owners alone?
Latest Answer: This law is applicable only if there is a deed. If the apartment owners are the undivided share holders of the all of the land parcel then this will not be applicable
Q:Hi, would like to know if a builder can retain club house under his custody after selling all the units in a campus? If an association is formed, shall this have to be transferred to association name or still it continue? after few years if he wishes to sell the clubhouse to a third party (in the event the association is not interested to purchase) is it valid? please give me your advise (I am from Hyderabad) Thank you.
