Q: At Thane, MH, one of the reputed builder had launch 20% per year subvention scheme. So far builder has charged 40% and this year 2020 end builder is demanding 20% more as per the agreement then total will be 60%.
Building is 44 floors plus 3 floors of parking but so far only plinth work and 2 floor parking structure is done. The cost to customer is not in compliance with the work done. Per agreement it is 20% per year but construction is not compliance with payment. What is the legal advise to customer here for this year? Hold or release another 20% payment this year.

Q: Today, dated 8 july 2016, i have enquired on possession for sapphire, site personnel informed me that, soft possession will be alloted by end of aug 2016. Anybody has the same updates?

Q: Hi what if the developer changes the number of floors in the building I.e someone who has bought 2nd last floor from top and the builder removes the top floor and the 2nd last becomes the top floor. What is the legal remedy for this issue? All this done without informing the buyer.

Latest Answer: Hi Usman, It is illegal. As per "Apartment Acts" across the country does not allow layout plans to be changed without the permission of existing home buyers. Recently, Supreme Court also confirmed that a developer can not make modifications in the layout plan and floor plan without the consent of existing residents. However, most of the developers are still violating these laws. They have been adding extra towers by reducing the common areas of societies. You can take legal step for that.

Latest Answer: Hi, Check the Title of the flat is clear or not. You don't need to pay Service Tax and VAT. Builders charge because it is thier regular course of business of building and selling so they charge Taxes. (but not of that Lady) Registration charges should be paid by you. After Registration is over. check the doucments online on Registration website showing details of Flat and Sale Deed Number. Is in your name and details of the flat are updated on the website. (Encumbrance Certificate EC is record of registered documents over a property check on website of Registration and Stamps Department).

Latest Answer: HI all, The maintenance cost also depend on the number of owners in an apartment. Less apartments will result in more service charge. Better make a forum unite all the owner of the society and pressurize on builders for unnecessary charges. Otherwise consult a god lawyer and follow what he says.
