Q:I had booked a flat under subvention scheme RERA P51700009055. However due to recent update by NHB, subvention scheme is no longer applicable and I can not buy flat without the scheme. Please suggest if builder is bound to return full booking amount along with GST upon cancellation of the flat

Builder is bound to refund the booking amount. If he is paying then ok and if he is trying to ignore and misleading you then Email from builder will play vital role. If builder fail to refund pre EMIs monthly as agreed by him in Email. Then you can cancel the booking and seek refund. Yes email are legally admissible as evidence in court.

You must have been given a receipt of the booking amount by your builder. The receipt must be mentioning terms and conditions. Send an email to builder that you want to cancel the booking and request builder to refund your booking amount. Let your builder mention in writing that 5% or 10% of paid amount would be cancellation amount. Accept the deduction under protest and then move consumer forum against builder for refund of balance amount with interest.
Q:======ALERT======I deposited the pre-launch booking amount of Rs. 7 Lacs.This was my first investment as NRI in India, I had made and I feel cheated as no receipt and allotment was issued to me. If you have valid receipt then you can claim,failing which you can send a Legal Notice that you do not want to purchase the flat and claim you money refund.
Thereafter if the Promoter/Builder would not comply then file a case in District Consumer Forum for deficiency of service and unfair trade practice.
Q:We booked a flat in Kolkata that is due to be handed in early/mid 2018. However, the location feels far to us now & we want to go back on the deal. The contract says the breach would amount to some Rs.50,000 penalty. We have paid 7lacs till now & ready to bear the 50k penalty. My question is, will this be a smooth process or is there a chance for the builder company to cheat us or extort more than 50k? Just looking for any experience/advice on the matter before I approach the builder company regarding this. Any helpful response is appreciated.
