Q: BOOKED A 2BHK VILLA IN 2009 AND STILL NOT A SIGN OF CONSTRUCTION. AFFECETD PARTIES COME FORWARD ,HIGH TIME TO ACT.
Latest Answer: Okay Folks , I do not think that refund is the best way out, After waiting for 8 years you need a Home which was booked . At least I am not looking for some petty compensation. Point is that after this long wait I can't buy the same locality houses within my capacity.

Q: I am having a flat in lotus boulevard no idea. I have been waiting for the builder to handover posession of the flat since Feb 13. ThE builder is to pay penalty for delay in handing over posession as per the agreement. Though there is no clause effecting penalty due to delayed payment of an instalment however the builder is indicating dependency of penalty on timely payment of all instalments. Also he is invoking force mature clause for work held up due to issue with NGT. Requested advice on what should be done to get maximum penalty benefit.

Q: can suggest here that all owners should ask compensation from builder. Like rent of the month for delay. Many owners are having loans and few are also staying on rent. So all owners must ask a fix amount per month for such delay. I shocked knowing that project is running from 4 years and no possession due to whatever reason. Ask for rent amount as per the rent rates in that area per month till you get possessions.

Q: After investing in a project, and being promised delivery within a year, builder has backtracked.
It's been 5 years now, the builder wants to change the registered plan of the flat and reduce area significantly.
What are my options for recourse?

Q: I have purchase a builder flat in sec. 76 noida in resale.Possession of flat is delayed by builder,on asking of penalty mentioned in builder agreement he is denying & told me that in transfer cases penalty is not applicable.

Latest Answer: Hi Manish, As per my knowledge, in resale cases, builder is not the first person(seller). So builder is not reliable to pay you penalty for delaying possession .

Examine in your mind-reasons for your investment, what investigation you did before investment and analyse how your investment turned sour to some extent and did not achieve your objective of getting a flat. So, before buying any properties check all the legal document again and again. Better, take the advice of a legal adviser. Can you claim for the depression and emotional losses caused by the delays.
