Q: I have a shop rented in Rachenahalli, Bangalore for past 2 year and I feel the tax I am paying is not legible. Could you please suggest what should be the tax for rental purpose on commercial complexes?
Latest Answer: Income tax is levied on the basis of income earned, from all lawful sources and it has nothing to do with commercial renting. It will taken as income from rent only.

A taxpayer pays tax on the annual taxable value of the property which is calculated after adjusted for following 1) Gross annual value (GAV) of the property (rent received or receivable or deemed rent), 2) Less actual municipal taxes paid for the property, 3) Net annual value (NAV), 4) Less deductions available under section 24.

Q: I am buying a investor flat. The flat is still not registered till now and I will be first owner. The flat is ready for the last 3 years. My broker is saying that I need to pay the property tax and the previous owner can't pay the property tax as it is not registered. Is this correct that until the property is registered the tax cannot be payed? Can the investor pay the tax for the flat that is not yet registered?

Latest Answer: The flat should be registered first,because if someone wants you whether this property belongs to you then the answer should be yes.Property tax have to be submitted it is compulsory but it is later process firstly the registration is required.if any information regarding property tax is needed.

Latest Answer: You have to log in to KMC website and fill up the Self Assessment form and submit it. After that you will get the details of your property tax so that you can download or take a screenshot of your paid tax. Q: The property will be leased to us, I needed to understand if we have to pay stamp duty on the total Agreement Value (comprising of Security Deposit, Rent and Maintenance Component) also specifically do we have to pay stamp duty on the maintenance component as well or should the stamp duty be paid only on the total of Rent and Security Deposit?

The MCG has made it clear earlier that it will not be able to maintain these areas with property tax alone and has asked the state government for permission to collect maintenance fees as well. Because of this issue chief minister Manohar Lal Khattar has asked the urban local bodies department to see if the property tax can be revised in order to ensure that funds are generated.

Q: Hello, I had purchased a flat in Indore last year in June-2015. As the building is under construction The builder is charging me Service Tax of 3.5% on the total agreement value.
Now the property is constructed & at the time of registration, builder is asking for 5% VAT on the total agreement value. My question is VAT amount is calculated on the total construction cost of my alloted area (as in this case 1190 sqft) & not on the Total agreement value of selling? Also he is not providing me with the receipt of the VAT charges applicable.


Also can you clear me with the current registry charges + any other charges applicable at time of registry?

The builder is asking for 8.5% of the total agreement value, but i think the registration is done on the market value not agreement value?
Latest Answer: Hi Rumit, For any sale to attract VAT, it should involve transfer of goods from one person to another. In case of under-construction properties, its the transfer of ownership rights from the developer to buyer in the form of a sale agreement, in select states. This tax is governed under the ‘works contract’ in the VAT law. For instance, VAT is charged at the rate of 1% of agreement value in Mumbai and Pune and 5% in Bangalore, but there is no VAT levied for apartments purchased in Noida-NCR, Chennai, and Kolkata.

Q: The Kolhapur Municipal Corporation (KMC) has started cracking down on property tax defaulters by sealing their properties.
Latest Answer: HI everybody, I am agree with you Pradyuman. As per the rules regarding tax recovery, the KMC can seal the properties till the defaulters settle the amount. The civic body may also go for forfeiture or auctioning of properties to recover the dues. Nothing to say on that as they are doing their duty honestly.
