Q: Hi, I recently saw a plot and want to purchase it.
The plot is having measurement 30 * 40 but it is having additional land near that is nearly 400 sq ft
The builder will give the plot to people who purchase both plot (thus making over all shape odd).
Builder is saying they will give A Khatha. I am sure about 30 * 40 site that they can give A Khata.
But what about the 400 sq ft?
Some where I have read that minimum 600 sq ft will get A Khatha.

Should I go for the property? Kindly suggest..

In site plan, 30 * 40 and 400 sq ft part is shown seperately..so I am not sure that is part of actual approved plan..

Latest Answer: Hey Albin, I do not think there is any hard and fast rule that if the plot is minimum 600 sqft then only you will get A Khata for the property. But can take legal help from some expert.

Q: i have booked a plot in ATS Golf Meadows Dera Bassi but the builder has levied me Service Tax on purchase of plot. I have heard and discussed with CA also, and he also told me that it is not applicable on Plots since it is not an under construction property, it is just a piece of land? Can anyone suggest me about this?
Latest Answer: Hello..Service tax is not applicable on purchase of land as it is a constructed property. Service Tax is applicable to construction of residential and commercial properties. If construction is done on the same land you bought ...then you are liable to pay service tax.

Q: Hello,

My mother-in-law has a property in Bangalore co-owned by her sister. It is written as a gift deed.

Plan- redevelop property into a 3 storey Flat. Fund mother-in-laws part of house.

Verbal arrangement- Her portion will be written in her and my husbands name.

Lawyer says - we cannot add my husbands name in the deed now.

His suggestion is - prepare an amalgamation deed in the name of my mother-in-law and her sister as the first step in the construction process for approval of plan.

Later- Prepare a sale deed which will then include my husbands name.


My mother-in-law has said that she will write a memorandum of understanding that the property will be 50-50 upon the completion of construction.


What I would like to know is

1.What is the simplest way to include my husbands name in the property?

2.What do we need to do so that everyone's position is safe?

3.Will we incur double the cost if we follow the lawyer's suggestion? In stamp duty or registration costs etc?

Q: I am residing in a Puravankara apartment. During the sale all the owners had paid charges towards BWSSB. As we havent yet received ( wont receicve atleast until 2016) Puravankara refunded the BWSSB to all the owners in 2009. The then presiding committee decided to collect the same amount from all residents and was decided that the same would be used when we recieve the BWSSB connection. The committee which took over next has decided that this will NOT be treated as charges towards BWSSB but will be treated as CORPUS FUND and have a given a deadline to pay up this amount. I have three questions:
1. Does the committee have the right to change the BWSSB amount in to corpus fund?
2. As the committee has converted this into a corpus amount the amount is different for diifferent flats. Is this right?
3. Is non payment of corpus fund a base for disconnection of services like water and electricity?

Please share your inputs.

Latest Answer: Normally a corpus fund denotes a permanent fund kept for the basic expenditures. If an association decides to collect amount from its members for Corpus fund, the member cannot opt for non payment. I think your association may thought instead of making burden on members, they could change the BWSSB amount in to corpus fund. I also recommend that if association is collecting Corpus fund from members, it should be equal for all members. The non payment of corpus fund cannot be a base for disconnection of services like water and electricity.

Q: What is the law relating to luxury tax in apartments in Mumbai? Can anyone provide me details as to when and how it is applicable ?

Latest Answer: Hi Smitakshi.. Luxury tax comes under Luxury Tax Act 1987 of Maharashtra. Tax is deducted based on some slabs based on the apartment/ luxury apartment/ service apartment rate. 20 percent of the luxury tax TDS is deducted as per Income Tax Act 1961.Luxury tax goes into State Government. It can be deducted as and when you pay the rent to the owner or you get it. It can be per day basis or month wise. Please consult with any lawyer or CA for further help on the same.

Contact your legal expert to know more about becoming a guarantor or co-borrower. Do not become guarantor, if you cannot afford it.If the other party can´t repay the loan, you have to repay it yourself.

It is located 246 km distance from its State Main City Lucknow . As away from City real estate demand is low or less compare to Allahabad.

Q: i have a question, i came across one builder in outer ring road, he is constructing one building G+4, in fact i have booked the flat with him and then he have shared the site true copy and rest of the documents for verification. the bitter truth i came across is that in the site plan and the working plan have huge difference in the SQFT. the approved plan says that the max sixe of the flat should be 600 SQFT and the builder is construction 950 / 1100 / 1180 / 1360 SQFT of size of flat. when i asked him the details, he told " all the flats in bangalore get constructed this way only, there is a bill AKRAMA-SAKRAMA , if it get passed by the govt. all will become legal. can someone put more light on this kind of deal ?. BTW i have canceled the booking and took my cheque back with no problem from this builder.
