Q: Hi, I own flat in RR & they are offering FITOUT certificates, which is not legal OC? Is this safe to move in with this certificate. And this soon my agreement date crossing 24 month deadline. I am really upset with there timeline. When I asked to builder office they said you can move in on you risk? But while booking they told me that it will be complete possession. This is really smart move to avoid further unseen problem by builder & create for customer. I am literally screwed-up here.
Latest Answer: Seeing the current malpractices by the builders/developers, I suggest that you double check following documents in case you have already decided to move in: 1) Check Fire safety certificate, 2) Cross check structural safety certificate, 3) Ensure that builder has applied for water connection etc., 4) Ask for lift fitness certificate and maintenance agreement. To save money builder have not taken AMC yet, 5) Ask for no dues certificate for land/plot. If builder defaults on the payments, you shall not be able to get sub-lease done and, 6) Ensure state electricity connection is in place.

Q: Hello All...We have a flat in Avenue I, global City virar. This month we are being offered 'fit-out possession' in lieu of final payment. My question is how it can be different from actual possession? Should we accept it? Do we have an option to reject it and wait?

Latest Answer: Hi All, let me inform you that in the last year, we got the OC also...despite our will, we took the fit-out possession. However, we had to wait for a whole year to get the OC.

Q: I also booked a flat in 2009 and since then helplessly watching anormous delays, further delays, leagl sanctions and holding of construction, short of raw material/labour etc.). I appreciate that legally, we might have limited options considering the way contracts have been written and also huge legal team which big builders normally have. But I strongly feel that we should keep sharing our views/experiences on this (and similar) forums and try whatever measures we have (consumer court etc.) so that it brings more awareness and information for rest of us. I hope these forums also make builders realise that their new project could be impacted if their brand is impacted by negative publicity/comments from existing clients. I Have Flat in Cielo and recd leter for Fit out possession from June onwards...? I really dont know what it means. We are not allowed to visit our flat since more than 15 months now
